Nicola, It does depend on the complexity of the visa, but sometimes you won't know this until you get into the process. I am not sure if you are lodging a skilled visa, but if you are, you need to understand the skill assessment requirements and how points are calculated. If you need state nomination, each state has different requirements around work experience and showing settlement funds. You may need an English test to meet the points, and this may need to be done for the skill assessment, and may be Academic or General. Documents for different stages may need different certification, and if documentation is missing or unclear, you may not get the points you think you have. It is worth weighing up the cost, and whether an agent is like an 'insurance policy'. It's not just the visa fee you lose if refused; it's the time and the unfortunate reality that Immigration policy changes regular, and you may be ineligible for another application in the future. Joy

Hi, If you meet the requirements for relationship registration in Qld (one of you living there for six months, neither of you married), you would be able to include your partner for points purposes and as your partner in the application. Does she meet the requirements for a skilled visa as the main applicant? Joy

Hi, The point score to get an invitations to apply for most IT related occupations (under 189 visa) is 65 or 70. Would you consider a 190 PR state nomination to bypass the 189? Joy

Hi, If your husband is eligible in this occupation, you need to look carefully at the state lists. A WA nomination would require a 12 month full time job offer from a WA employer; an SA nomination requires him to meet the Supplementary List nomination requirements and NT requires evidence of settlement funds, the amount depending on the number of applicants. He will be eligible to be sponsored by an employer on a 457 visa if holding a visitor visa without the 8503 condition. Joy

Yes, the 489 is an eligible visa for an onshore 189 application. Depending on the date of your skill assessment, you may be able to use it for the 189 visa. Likewise with your IELTS test (if sat), depending on its date. You do need to pay the visa application fees again. Joy

Hi Ben, Has the company let Immigration know that they are not longer supporting your 186/187 nomination? Have you received the letter from Immigration stating that your 457 visa will be cancelled? If so, what is the date on the letter? Do you have a partner? If so, do they have an employer who may sponsor them? Joy

Yes. It is not a visa condition of your 186 to work for the sponsoring employer.

Hi, I agree that this website has a number of inaccuracies, but I note the following excerpt from DIBP's Procedural Advice Manual (PAM). The PAM guides Case Officers in their interpretation of Migration Act and Regulations. SkillSelect applications - Applicants subject to an 8503 or 8534 condition There is no requirement for the request for a waiver to be made in writing by SkillSelect applicants. The act of applying via SkillSelect is (under policy) considered sufficiently compelling for the ‘no further application’ condition to be waived in all cases where the applicant or dependent family member applies for one of the visas listed in section About SkillSelect-related waivers. This section is copied below. About SkillSelect-related waivers From 1 July 2012, regulations 2.05(4AA), 2.05(4), 2.05(5A)(b) and 2.07(AG) enable conditions 8503 and 8534 to be waived if the person has a ‘genuine intention’ to apply for a: General Skilled Migration (GSM) visa EA-132 Business Talent visa EN-186 Employer Nomination Scheme visa RN-187 Regional Sponsored Migration Scheme visa or EB-188 Business Innovation and Investment (Provisional) visa. These waiver provisions allow these particular applicants to make their application through SkillSelect in spite of a ‘no further application’ condition on their current visa. Joy

Hi Alix, You are eligible now to apply for a 457 visa as a radiographer. If you are working in a designated regional area, and you hold your full registration or licencing, you are eligible to be sponsored on a 187 Direct Entry visa (PR), and you do NOT need a skill assessment. Joy

Yes. You hold PR and you are free to work in different states. As noted in the thread, it is not a condition of your 190 visa to remain in WA, it is only a moral imperative.
