    Hello, You need to be outside Australia to lodge a prospective marriage visa. You may also be eligible for an offshore spouse visa. You are able to lodge this visa BEFORE you get married, provided you get married DURING the processing time, which is currently 12 - 15 months. You do not need to be living together but need to show that you are a genuine couple and ongoing couple. You must show that you intend to marry and you must marry outside Australia. Joy

  6. hi, Yes, you can claim maximum overseas work experience points if the eight years were in the last ten years, at the time of invitation to apply. You need to be able to verify all claimed employment at the visa stage, not just at the skill assessment stage. Joy

  9. Hi, It is important to find out as much as you can about the agency you intend to engage. The partner visas fee is so costly that you do not want to go through the heartache of lodging, waiting the average 12 - 15 months processing time, and then have it refused. Joy
  10. Hi, If you are looking at a skilled visa, you might want to think about moving to the Northern Territory to live and work on your current visa. Hairdressers are listed as in shortage on this area.   11. Hi, I agree with other posters. This applies to eligibility for a 457 visa. You must meet the Vetassess skill assessment requirements as a first step in a skilled visa.

Hello, If you have lodged a Subclass 100 visa, your partner CAN be inside Australia when the visa is granted. 100.4 Circumstances applicable to grant 100.411 The applicant must be: (a) in Australia, but not in immigration clearance; or (b) outside Australia; when the visa is granted. It is recommended that you seek professional migration advice if you unsure of visa conditions. Joy
  13. Hi Dan, If the nomination is not approved prior to the end of your current visa, you will either need to leave Australia, or lodge your 457 visa and link it to the pending nomination. You will then hold a Bridging Visa A. Joy
  14. Hi Laurence, As you hold an IT degree, you are eligible for both a 457 visa, and a 187 (Direct Entry) PR visa - if you are living in a regional area of Australia. You do not need post-degree work experience to qualify for either of these visas. Joy
  15. Hi, Yes, you are eligible to be sponsored on a 457 visa (showing three years of paid work experience). You may also be eligible for a 186 PR employer nominated visa (through Direct Entry), if you are able to pass a skill assessment and you have three years of post-qualification work experience. Joy
  16. Hi, Most employers can obtain approval to sponsor, even sole traders or businesses trading less than 12 months. Labour market testing is not required for all occupations. Joy

We would need to know what visa your son in law holds, and when it expires, as he remains on this visa until either it expires (at which time he goes onto a Bridging Visa A, associated with the lodged 820) OR a decision is made on the 820 application. If he is on a Bridging Visa A and wants to travel, he does need to apply for a Bridging Visa B. Joy
  18. Hi, This is possible for a 457 application but not for a 187 visa. If the refusal is not appealed, a new nomination will need to be lodged, and new visa application. I think professional migration assistance would be helpful in your case. Joy
  19. OK. It is the nomination that has been refused. Your nominating employer would have the Immigration letter outlining the reasons for the refusal. The date on that letter is very important. Joy

  21. Hi, I am sorry to hear of your 187 refusal. When did you hear of the refusal? There are strict time frames on lodging an appeal. Was the nomination refused? And therefore the visas? Or were the visas refused after a successful nomination? Are you in Australia or offshore? What was the reason for the refusal? These questions would need to be answered and understood by anyone you're working with on an appeal. Joy
  22. Hi, Bear in mind that it is as moral obligation (not a legal obligation) to live in the sponsoring state for the first two years of your 190 visa. You will find that some states claim on their website that you MUST live there, but it is not a condition of a granted 190 visa. They are issued with nil conditions. Joy
