  2. Major surgery is no way to spend a holiday, also it will be unlikely that he will be able to work for at least a month or two. Does he have the funds to keep him tied over while he recovers. The reciprocal with Ireland covers necessary emergency treatment in a hospital, there is no medicare along with that so stuff like Doctors visits and costs which might be necessary post treatment is all out of pocket. As for the WHV there's no freezing, discretion or exceptional cirumstances.
  3. Friend of mine overstayed his WHV for a few years and got banned, he was able to come back after 4 months on a permanent ENS visa. However that is not like fraud PIC which is a strong disincentive to provide bogus information for the purpose of applying for a visa, if you provided false information to try and get the 2nd year visa and got caught out (and I know for a fact DIAC take the 2nd year WHV scams very seriously) Have a read of this http://www.immi.gov.au/skilled/_pdf/fraud-pic.pdf I would seek the services of an experienced MARA agent.

It's probably that SA have an internal list of visa's that they are referring to, that list has probably been updated since July so the ENS121 is the old subclass and is probably not on the new list since its been replaced by the 186. I would be complaining or make a complaint, maybe you will get something out of them if shout enough.

  12. If you buy yourself a plane ticket before hand then they will give you a bridging visa, their policy is if you overstay but willing to leave of your own accord you will avoid detention. If they pick you up on a raid, randomly or you try to avoid detection they can detain you as your intentions are not to leave.
  13. Its likely that she was refused because she spent to long in Australia, DIAC are happy enough to use this as good enough excuse to refuse if they suspect visa running or someone is not going to be genuine.
  14. Sorry I forgot to mention something. lebourvellec is correct......... even if you were successfully granted a visitor visa and you are refused at the border a refusal carries a 3 year ban. I did mention it was worth a try to get a visitor visa but forgot to post the bit about the risk of a 3 year ban. Apologies

After 24 months on a working holiday visa you might be lucky to be granted a Tourist visa, DIAC would have good reason to refuse you as you have built up many work contacts in Australia over the last few years and could be coming back to pickup where you left off. This is referred to as a 'Visa Run' by DIAC, worth a try I suppose but definitely not a guarantee. If you do manage to get a tourist visa it will be probably be under restrictions. My brother-in-law is a customs officer and he says that they are really cracking down visa running on British and especially Irish people these days due to the economic situation in Europe. Also on the new 189 & 190 GSM you can now get a bridging visa onshore if you apply, but you can only apply if you have been invited after lodging an EOI I think your best bet is to find a 457 sponsor in the next 2 weeks. Good luck EDIT: A "No Further Stay condition' simply means that you cant stay beyond the length of your current visa, it doesn't mean that you can never return to Australia as a migrant. I think you might be a bit confused over that bit.
  16. If you fail the Fraud PIC (Fraud Public Interest Criterion) I think it carries a 3 year ban.

  18. Possibility Yes, part of the problem is the high $AUD, The super profits mining tax and the Carbon Tax. Australia is simply priced out of the market these days. Although the one thing that Australia does have is stability, a lot of other mining resources in some of these other countries that are not that politically or security stable. If the industry takes a tumble the $AUD could fall against the $US, this might improve the £ against $AUD but it will never be back to the level it was 5 years ago. The bad news is there is a good possibility that there will be job losses and unemployment will rise, so although the £ would be more favorable it would not be a good time to move to Australia even if you had a visa. The last time something of this proportion happened was GFC in Nov 2008 and DIAC brought in the Priority processing on 17th Dec (I remember it well), a few months later and Skilled migration was cut from 133,500 to 108,100.

  21. I think it would be easier to just do the test again, if you are as good as you claim then it should be no problem to get the result second time around.
