1. finally got to the bottom of this- my migration was incorrect and the reason being is that a good proportion of his clients have actually been onshore when their visa had been granted, according to him the department of immigration has acknowledged the clerical errors with this and have ironed out the 'kinks within the system' to avoid thus happening in the future. So looks like I will have to go to NZ after all. Will make the best of it though as I have never been before. First family holiday abroad :-)
 2. hmmmmm this is very puzzling- my immigration agent directed me to a page from the department of immigrations 'Extranet' This is in essence the guidebook available only to the department staff or registered migration agents. The reason he did this is because I questioned the same thing. Leave it with me and I will ask him to do a print screen of the visa claus and come back to you.
 3. I haven't done it yet but this is what I will be doing in a couple of months. My migration agent has advised that I can enter on the e600 visitor visa with no issue. I was very nervous of that prospect but he has assured that a good percentage of his clients do the same thing with no problems. Dependant on whether you are applying for the subclass 100 or 309 will dictate whether you need to vacate the country when it comes time for your visa to be issued. (For example I have applied directly for the subclass 100 so will not need to leave Aus while my PR visa is issued)

 5.
Back home and loving it!
