Visa Capping - Senate Inquiry

Hi ozzieland, since both new-SOL and old-SOL are been processed concurrently how does the new-SOL applications fit in with existing priority processing arrangements (which only has old SOL and CSL)?

It seems to me that either:

CASE 1: They they give CSL-priority to new SOL applicants. That's unfair to 2231-79 (ICT recent grads) who just applied before the change.

or

CASE 2: They don't give CSL priority which is unfair to 2231-79 (Specialisations) because they are in CSL currently.

Those applicants that applied before 1-July would still have been eligible for under new system. If its case 1, then they (me included) are victim of bad timing I guess.

My understanding is, the reason why they have not changed the priority processing is because although the new SOL is effective, they have the old CSL applications to complete. I only hope that they do not have too many left because the whole logic of having opened up the system from 1st July does not make any sense without the new Priority processing and the SMPs.

This is from my CO on 5/july: 'The Ministerial Direction No 45 is still in effect. As a result yourapplication will still be processed in accordance to the priority outlined in the direction.'

This is the same answer I got when I ran DIAC - the Ministerial Direction No 45 still applies!!!

Yes Thats Correct guys. And if you want to know where have they gone in terms of dates, just blank e mail at aspc.processing@immi.gov.au or gsmb.processing@immi.gov.au and you will get the result.Till now they have processed 7th March 2010 cases of CSL list so i do not think that many are left of CSL in pilepline as 7th May was the cut off date for offshore applications.

Guest khotkunal

Just to update you guys on the status of CSL applicants being processed.

DIAC have already run into the April offshore CSL applicants..many April applicants have got their visas and even 90% applicants till March 2010 have got their visas..SO do not know may be their system generated mail is not updated because I am a 23 March applicant and have got my visa on 9 July and I know a couple of applicants who have similar timelines who have got visas on 1 July...

So I hope they start processing earlier applicants soon...I guess they are planning to finish CSL applicants by July end. So that the new SMP's coming around Aug first week they can start the earlier applicants and the new SOL applicants...

This info is based on the first hand info I have got from different forums...So this is not the final word, but my opinion.

I hope this helps...

Thanks

KK..

Well Kunal have given us an intresting picture!!!.If they have gone upto june of CSL then that can be a good news for us as there would not be many left in the queue in that case!!.So the next priority comes non CSL state sponsored i think!!!! they would be the one in the queue next!!

Actually it is upto 7th May only since new applications were suspended from then onwards. Only onshore applications were accepted and I do not think there could have been many CSL onshore applications.

The latest news abt Chris Evans follow this link

Immigration debate killing govt: Evans - Yahoo!7

Nowadays when one speaks of immigration in Australia, the first thing that pops up will be asylum seekers. No one gives a flying hoot about those lives being affected by the recent, constant changes being done by Evan's department.

An interesting is that on one of the debates on immigration held on the local ABC channel with a distinguish panel of professionals and the Evans himself all agreed that it was inhuman to leave the asylum seekers in uncertainty for 2-3years whilst waiting for their application to be processed. Well if that's the case, how is that fair that people in the GSM queue are made to wait till 2012 and 2013. Are we any less human that those asylum seekers? If you cut me is my blood of a different color? Even so this is all due to the screw up of Evans himself. Yes, he want to make the GSM process better, Yes he want to attract the highly skilled professionals but a better transition process could have been put in place. The change he made was not minor, but something major and a gradual change could have been a more decent and humane approach. After all its people's lives here are are talking about! It seems to be Evans can't make up him mind on what he wants and just wants to aply the 'wait and see' approach'. If that change dosen't work, implement another 1-2 months later to 'try' to fix his screw up and what has this led to now... the mother of all screwups in a form of a 'Cap & Cease' bill which he is so desperately trying to pass.

Hi Guys,

Yes this is true that lots of 175 applicants are getting the visas. But I am surprised that to which priority number do they belong from. Here is another example of 175 and 885 applicant who got the visa recently...

Dear friends,

I am Sanjay, I am new in this forum, i really need help,

I have completed my Master of Information system in 2008, after that I have completed Professional Year Program(ACS) in ICT Specified by the minister in April 2010 to get 10 bonus point. Currently I am holding 485 Temporary Visa.

My ACS assessment letter shows ICT (recent Graduate) + professional year

I have applied for onshore subclass 885 (permanent residence) with 120 points on 16th April 2010.

My question is, how much chances to get visa ?, or they will put me in cap & Cease.

I think, I will be in cap & cease if the visa capping bill pass in parliament.

I really nee a help.

I rang to DIAC they told me they are not sure about it.

help me

cheers,

Sanjay

Dear Sanjay,

nobody will be able to answer your question at the moment. The bill has not been passed into law yet and even if it comes into effect one day nobody knows how it will be used and who will be affected by it. The bill gives the Minister the power to cease your application but it's not certain who he's aiming at.

At the moment the only thing you can do is wait .... like so many others do across the globe. From my feeling I would say that onshore graduates with a running PR-application are safer than offshore applicants but this is just my personal opinion and not on based on any facts.

Thanks

Uli

Uli,

Thank you very much for your reply,

why, I am very concerned because there is still 6400 IT (nec) application in pipeline at 30th April 2010, I am falling in IT (nec) recent graduate.

I have spent nearly $15,000 in my Professional Year PRogram (ACS PYP) specified by the minister after my Master degree. I have spent total $55000 in education in Australia.

If, I will be under cap & cease than I almost loose my four valuable year of life and nearly $70,000 including every expenses.

cheers,

Sanjay

I cannot agree more. I have, 4 weeks ago, emailed every program on ABC and SBS (7.30 report, four corners, insight, dateline, lateline, World news Australia etc...) and the only responses I got were emails thanking me and saying that my email was referred to some other producer of another program. I heard nothing since and the only thing on the news are the asylum seekers. It seems to be a disadvantage to us going under the radar.

Does anyone have the appropriate website/email to potentially interested British Media. BBC perhaps? If someone is happy to let me know what email addresses or website to use, I'll be more than happy to email them. I will try NZ media as well (my lawyer gave me that advice).

cheers

Do you work full time in IT? If you do try to work towards getting sponsorship. Its the safest, quickest way to PR (856 ENS visa).

If not, look for IT job and dont wait for PR to find work. May take years after years and anything can happen in mean time including your application getting culled by this moron Evans.

Its hard to get a job without PR, but not impossible.

And I bet a tiniest fraction of people listened to it (aside from affected parties) if not switching to music channel halfway.

It's a good question but the answer is :

Asylum seekers differ to usual visa applicants in that many are held in detention centres with very limited freedoms, or those who on general release in the community are probably denied work rights and other privileges, as well as separation from family.

I think normal visa applicants enjoy a little more freedom. It's a more gentle type of hell.

I too hate the delays, as any delay these days becomes grounds for capping and ceasing. It's only the Minister who has an accurate picture of the profile of these older and supposedly unwanted applicants.

Guys I Have no doubt in my mind that minister is going to cap all the onshore non CSL visa applicants!!! Please do not take it offensive..I am also one of you (IT Recent Graduate 2231-79).The reason behind my thought is that all the CSL have been finished... we all know if you have occupation on CSL you will get PR in 15 days,....

Second thing 168000 places are available in this financial yesr and Evans says 68000 reserved for employer sponsores and i bet he can barely get 6800 (that too is big i think frankly) in such a uncertain financial conditions no employer is willing to sponsor anyone( even i am working in IT Industry ), no one is wiling...

See what this government has done is when country was in GFC they wanted flow of money and students were the easiest way, they got it and now when GFC is over, they need a way to throw them out and that is Caping and ceasing.. Simple..

because there is no reason for delay... If he want to grant a visa..why is he delaying.. when he has the places ..he has a baclog why is he not clearing it...instead he is stressing upon that C&C bill should be cleared in parliament...

Guys i think signals are clear for us!!!

It is just we have to understand it!!!

In a sense you are right, but it's not really that 'gentle' as you can't sponcer your spouse (seperation of family) or leave the country easily to travel (restriction of movement/freedom) on a bridging visa.
