Partner Visa Advice

Hi Guys,

I am currently nearing the end of my final WHV and looking to explore my options. I have been in a relationship with my partner for almost 2 years (I know this doesn't count towards anything) but we have been living together for 10 months now. As this is just shy of the 12 month requirement I understand this may not be enough to apply for a Partner Visa.

Does anyone have any idea of what I should do?

Book a one off consultation with a good migration agent. 

In the meantime, make sure you have proof of the date you moved in together. Make sure you have some bills in joint names, proof of shared finances. If allowed in your state, register your relationship. 

The agent will have some strategies. If all else fails, you may have to leave the country temporarily, but your time apart will still count towards your qualifying period. Don’t, whatever you do, overstay, as that could ruin your chances of a further visa

I don’t know if the same rules apply now? but 10 years ago, my daughter was in Sydney on a WHV and like you her visa would run out before 12 months living together with her partner. They registered their de facto relationship with NSW government, which resolved it, and applied successfully for the partner visa. I don’t know where you are? as I don’t know if this is still accepted or if all states have this system.

Just fyi the 12 month requirement is not needed if you get married.

I literally came to Australia to spend time with someone (Which I mainly knew from the internet for years, and a previous trip in Brisbane a few months ago), got some immigration advice due to us deciding to stay together, which lead to getting married quickly since we didnt have that 12 month requirement or a ton of evidence of living together outside of the hotel.


Though I definitely felt like many agents didnt feel comfortable with our case due to the lack of living together for 12 years which I honestly found kinda extreme, it isnt like you can live together if you are in different countries which both have serious visa requirements.

Got PR at the end of the day 25 months after applying for my 820 onshore so it turned out great.
