Do you re-upload all previous evidence for the 801 visa?

Recommended Posts

Received my onshore 820 last month and will be able to apply for the permanent partner visa 801 on November so I am wondering, do I need to reupload all the evidence  from 820 to the 801 application or do they already have access to it?

Mainly because we received an RFI a couple of months before being granted the 820 so we had to upload whatever latest evidence/statements we had explaining our situation so if I apply for the 801 in November we wont really have that much new evidence, firstly due to lockdowns here in Melbourne and secondly because we are very indoors computer people so stuff like restaurants, fancy clubs isnt rly our thing.

Also an additional question, considering the RFI asked for an Aus police check around May I assume I can reupload the same one for when I apply in November since it hasnt expired?

You won't need to upload all the basic stuff like birth certs and passport.

They will want updated proof of an ongoing relationship.

If they want a fresh police check they will ask for it but its unlikely.

When you applied for the 820 you also applied for the 801: 820 is a provisional visa you are granted as a step along the way. therefore this is just like an additional request for evidence to ensure the relationship is ongoing.

My concern is that if it is stand alone they dont have access to the previous evidence and statements, and our relationship is not as usual, for example he doesnt work due to disabilities and I assist him at home which we live and we also dont go out often we had to rely on statements that explain our situation such as lack of frequent social activities.

If they dont have the previous evidence then it means I should reupload things such as personal statements/bank statements to firstly to show the special type of relationship we have and secondly to show our consistency, especially since we wont have much new evidence since the RFI was on May and we can apply for 801 on November which is just a few months

They have access to all the previous documents.

When you applied for the 820 you were also applying for the 801. The 820 is granted as a provisional visa while they wait the two years to decide the permanent visa. (Same as the 309/100 offshore). So all you need to do for the 801 is update your information. Don't upload anything again unless they ask you to.

What they want to see now is ongoing evidence of the relationship - any big joint purchases such as a house, car etc. new bank accounts with joint incomes going in, and in normal times evidence of trips together.

You have to upload new personal statements, so those can explain your circumstances. Also you will need new Stat Decs from friends/family and those will help to show that its an ongoing relationship. Also if you have any evidemnce of things you do for your husband because of his disabilities, include those, as it shows proof of your relationship.

Out of curiosity what kind of proof would show that?

Because for our case the only way we showed that was via personal statements explaining our situation and how he supports me financially with bank statements showing that as well as my myki public transport history that shows I only really go out to get groceries and shop for both of us, what else could be used to prove that I am pretty much mostly staying at home and helping him?

Never having been in that position, I don't know. Maybe a Stat Dec from a GP or specialist?  Statements from friends who know that is your situation? Expenditure on any special equipment to help with his disability? I'm just guessing here mind you! Any claims he puts in for welfare benefits with you named as a carer?

Other evidence you can include showing you are a couple might be updated wills, life insurance, any official notifications of next-of-kin? Anything really that shows the two of you have an intertwined life at the same address.
