Skilled Regional Visa (489)

Hi

Apologies in advance if this is a repetitive thread and I do tend to waffle on...

My husband and I are looking to move to Australia. He is an Aussie from Warrnambool and we would like to base ourselves there. I qualify for the skilled regional visa (489) as I’m an HR Advisor and I’ve just had my qualifications checked and cleared. It’s only after I’ve put in my EOI that I’ve researched through other government pages (that are not SkillsSelect) that I’ve discovered 2 things:

- Victoria is not currently accepting any EOIs at the moment

- You are required to have a job offer on the table

Is this right? How can you expect to get a job offer before you have a visa?

Another option I think may be suitable is the family sponsored thread of the 489 visa, but can I apply for this with my partner and his family being in Victoria, or does it have to be a relative of mine? I can’t find guidelines on this.

I know we could apply for the spousal visa, but having heard what an intrusive process it is with scrutiny of your personal life, not to mention the 2 year wait time it seems to have at the moment, I’d rather explore alternative avenues first.

Any help would be greatly appreciated.

What do you mean, 2 years wait time?  If you are currently in the UK, the application takes only a couple of months to go through.  

You may be confusing it with the fact that you must be married (or in a de facto relationship) for 2 years before you apply.

The process does require you to provide bank statements, leases and bills in joint names to prove you are actually living together and sharing a life. and yes, it is a bit tedious.  Most people also submit photographs of holidays together and so on.  But it's not like they ask about your sex life or anything!

No on the government website it says that for the spousal visa the current wait time is that they will process 90% of applications within 24 months. 

We’ve been together 7 years (only married for 3 months), have a mortgage and joint accounts etc. etc. Another reason we were put off with that avenue is because it costs double the amount of the 489.

Which visa only takes 2 months?

If you look at the recent experiences on here the 309/100 is being granted in the UK in 2-3 months. You need to provei you are married, or have been in a de facto relationship for 12 months.

Yes its a lot of money but sounds like an easier option if you are struggling to get a job offer.

The waiting times reflect both applications made in Australia and applications made from outside Australia.   Applications made from outside Australia get priority and are processed faster, presumably because Immigration takes a dim view of people sneaking into Australia on a tourist visa with intent to stay permanently.  We've seen several recent posts on these forums from Brits who've had their partner visa approved in 2-3 months.

Victoria has just shut down the 489 program "temporarily" so it's not even an option for you now. If, as is likely, they don't open it again for several months, then you have to find a job and then apply for a visa, you could easily be looking at  2 years to get that visa.  

You can get family sponsorship if "your and your partner's only remaining relatives live here and you want to be near them."  So if neither of you has any family in the UK, you can get family sponsorship.  If not, no go.  Anyway, it's likely it would take longer than the partner visa.  When they say something like "unavailable due to low processing volumes" on the timetable, that doesn't mean it's fast. It may mean they only grant a few each year and the quota has already been filled.

I didn’t pursue this route in the end due to Victoria not accepting expressions of interest, plus needing a perm job offer before applying.

I successfully applied for a spouse visa which was granted last week after submitting in July 2018.
