309 advice

Hello everyone!

My husband is American with Oz permanent residency, who had been living there for 15 years before leaving for a contract job to Malaysia in 2012. Since then connections with Oz were only a couple of very short visits and 6 months employment in 2014. We met in Malaysia (when he was there on a contract) and got married in 2016 on Seychelles. All together, we've been through 1 year of long distance relationship (plenty of evidences of constant communication and mutual visits), 1.5 year of de facto in Auckland (joint bank account, and my name on the rent agreement, plus lots of photos, a couple of people who knows as well, and a holiday together), and now almost 2 years of marriage in Dubai (well, from here I guess we are good). His Dubai contract is set to finish in exactly a year from now and we are thinking through our options on where next. The most appealing is to go back to OZ, I always wanted to, plus my husband has kids from previous marriage there (I have a son too, they hit it from the day we met (my son was 2 yo) and now they are team DadSon, even competed in triathlon together ? ).
Our main concerns are:
1. I am a Kazakhstan citizen, so is my son. And even though we haven't been back to my home country for almost 7 years, I guess it might put our application under at least moderate risk category
2. We have 30 years age difference. Yes, he is older. Yes, I really love him. No, not because he is American with Oz residency. I blew my independently obtained NZ residency for him, moving to Dubai, so now we have visas problems all over again. He is just that awesome! But I am afraid the "Olimmpian Gods" might find it suspicious, don't you think? ?
Questions are:
1. We do not want to separate for 9-13-18 months before 309 will be granted (fingers crossed), is it possible? We understand he has to be in Oz through that time to prove his connection by mortgage or a house lease, or electricity bills.

2. Couldn't find any information on that, but it seems unreal that immi wouldn't request from my husband any evidences of financial ability to sponsor us. Not lots of cash on hands,  not secured job in Oz, really? ?

2. A very good immi adviser can be a lifesaver in our case, can anyone recommend one?

Don’t assume it’s always going to be a given with the RRV.

I realise he has children there but if he hasn’t made an attempt to live there for a while they may only issue a short one or some such.

Don't really know how it works, but the last time we applied last summer, they gave him 1 year travel condition. We talked to someone in a consulate here in Dubai, they said it just needs to be done every year until he returns back and settles. But anyways, thanks for heads up, it's about time we look into that again!

Hmm, I'd perhaps double check that with a decent migration agent to be sure.

I read about that, but how do I get on shore on the first place? Visitor? Student? Would immigration officer give me any of those if it is kind of obvious that our intention is to live there. We for sure do not want to plant any "not genuine intentions" seeds into my immigration file. 

You may want to run this all past a migration agent to come up with a plan going forward. 

TBH you seem to have some aspects to your place that could potentially cause issue if not handled correctly, it would be well worthwhile at least consulting an agent to give you some feedback on your plan. 

Off shore partner visas usually mean both the sponsor and the applicant are off shore during the processing and once the visa is granted, couples usually travel to Aus together. I'm not sure what the implications of your husband being in Australia for possibly up to 18 months without you would be while you sit and wait there for a grant.  

I'm not aware the financial aspect has changed since I applied. Then we didn't have to provide proof of funds for the sponsor or applicant, just have a plan for when we arrived in Aus and to be able to show our finances (eg salary slips, bank accounts, savings) for the time prior to lodging, but it wasn't like we had to earn a set amount or have X saved or anything. Just that we were able to show we shared our finances and life together. Husband was the main earner and this was reflected in the evidence I provided and in our statements.

Back to my original question ? Where to find a decent one? Spent last two days going through web pages of different agencies, not one gave me that gut feeling yet! 
We know it is going to be a long and expensive process, we are ready for that. But that would really help if we know we are in great hands! Someone who cares, not just earns money would be perfect!

That would be ideal! Unfortunately, so far it seams to work only if the sponsor is AU citizen, PRs are treated differently. But, as you said, the agent will help as to sort out our possibilities!

Any of these agents would be a good starting point.
