kateNollie
I'll keep it factual Im an aussie citizen and in 2013 my wife and I and daughter moved to Perth. My wife was given PR straight off the bat on a spouse criteria. We stayed 2 years then moved back for unforseen circumstances. We would now like to head back to perth again in the next year or so but didn't do anything with the visa when we left? What are we meant to do? Do we reapply for a spouse visa, starting again, Have no problem going through it all again, its probably our fault for not sorting something for the mid term whilst back in the UK, but dont want to start something off, to find that we should be doing something else halfway thorugh. Any help would be appreciated. Thanks Ollie
Quoll
When does the travel portion of her visa expire? If you moved in 2013 it may not expire until 2018 if you're lucky. If it's expired or will do so before you can return then she should apply for a Return Residents Visa - should be reasonably straightforward as you are an Aussie and there were unforeseen circumstances after 2 years residence
VERYSTORMY
The travel rights attached to her PR are normally valid for 5 years from grant. So, if she goes back before the deadline, she doesn't need to do anything. If it is after deadline she will need to apply for a resident return visa. kateNollie
Resident return is ok from the uk? Don't have to be there to apply or anything like that? Tia
Guest
https://www.border.gov.au/Trav/Visa-1/155- If the travel aspect of the partner visa is no longer valid then you apply before you head to Aus. The link explains the ins and outs.
