perm resident and citizenship requirements

Can anyone tell me how many days per year you can be out of the country and still qualify for citizenship. this is when you are here on a permanent resident visa.

 

I heard someone mention you can only be outside Oz for 90 days a year. i will always have a place here and live here but as i work 28/28 i want to holiday more than 3 months this year but afraid it may mess up my citizenship chances.

If you have been engaged in particular kinds of work and can provide evidence from an employer that shows you have worked in that occupation for at least a total of 2 out of the past 4 years and you were required to travel outside Australia for that work, the following special residence requirement may apply to you.

Requirement: You must have held a valid Australian visa for 4 years, immediately before applying, including one year as a permanent resident immediately before applying.

 

 

You must also have been living in Australia for a total of 16 months (480 days) during the 4 years before you apply, with at least 4 months (120 days) of that time in the year immediately before your application.

 

 

The following is list of relevant occupations for this special residence requirement:

a member of the crew of a ship or aircraft

a worker on a resources installation or a sea installation

a Chief Executive Officer or Executive Manager of an S&P/ASX All Australian 200 listed company

a Scientist employed by:

an Australian university who has attained a PhD in their field of speciality and is undertaking research and development of benefit to Australia or

Commonwealth Scientific and Industrial Research Organisation (CSIRO) or

a medical research institute which is a member of the Association of Australian Medical Research Institutes (AAMRI)

a medical specialist, internationally renowned in their field, who is a fellow of an organisation listed in Schedule 4- Part 1 of the Health Insurance Regulations 1975 (Cth) and holds a relevant qualification in relation to the organisation

a person who is a writer or is engaged in the visual or performing arts and who is the holder of, or has held, a Distinguished Talent Visa.

You cannot claim a special residence requirement in conjunction with Ministerial Discretions 3, 5 or 6. The special residence requirements only applies to you and not your spouse or any other person included in your application for Australian citizenship.

But, i will say they never checked when mine was done. I was not sure how much i had been out of the country and the form didnt ask for it and they didnt ask at interview. I still dont know, but i must have been close to the limit at the least.

Did you use the exemptions? Was looking in to it for my OH if he was to stay in his current job when we move.

It might be one of the checks they do VS - checking exit/re-entry into Aus - would be simple for them to do

You must not be out of Australia for a total of 12 months in the 4 years preceding application and no more than 90 days in the year before application.

 

There are some exceptions for people working on resource projects or at sea

 

There are also some exceptions to the requirement for 4 years of residency. In some circumstances you can get citizenship after as little as 90 days.

Please can you provide a link to that, as in my 7 years on here i have never heard of it

As Rupert said, Lateral Transfer into the Army, or indeed any of the 3 services - http://www.citizenship.gov.au/applying/files/support_docs/support_1300t_1290/resi_variation/

 

Also http://www.comlaw.gov.au/Details/C2010C00720/Html/Text#_Toc275938747 - Paragraph 21(2)c and Paragraph 23 which qualifies the "relevant defence service" as 90 days.
