Hey guys, hope your day is good so far :)

 

I have a few questions relating to the process of sponsorship. Im currently working in Adelaide on a Working Holiday Visa and I work weekends only. My manager is extremely eager to sponsor me to allow me to stay in the country and fill a gap in the business but im not sure if I would qualify for the sponsorship scheme?

 

I heard you need to be earning about $48k a year? but ive also heard that sometimes they dont check your bank? Also, I work in skydiving, which is not on the list of acceptable forms of employment, although Ive also heard that you can be sponsored in any sector as long as your apply?

 

I know you have to fill a position that cannot be filled by an australian, which the role im doing is extremley specific, im not sure there are that many aussies wanting to apply for the job in adelaide.

 

Basically, im looking for a bit of advice from anyone who has gone down this route, or has more information on it. I have already checked the imi website (http://www.immi.gov.au/skilled/skilled-workers/sbs/) but its quite vauge as expected.

Ok, short answer is no, it can't happen.

 

To be sponsored your job does have to be on either the sol or the csol. It used to be that there was a bigger selection of jobs, but that changed last July.

Also, to be sponsored the job has to be full time. Weekends only even if on the list would not be acceptable.

Different visas have different wage requirements, they do check them.

As above X2.... I'm afraid that full time work and being on the list are two essential criteria. I think the minimum wage requirement went up recently too, I think it's around the 51-52 mark now. Its not your bank account they check, but what's written in your contract of employment.

The current TSMIT is a base salary of $51,400 plus superannuation. This will most likely increase from 1 July.

The company can be monitored to ensure you are being paid the correct amount. Immigration can also check information with the ATO. If you are not being paid correctly your visa will be cancelled.

It depends on the job you are doing. As an example a “Parachute Rigger” can potentially be sponsored for a 457 visa.

May be possible depending on the specifics but from what you have posted so far, probably quite difficult.

The ATO recently announced they would be sharing info with DIAC re individuals and business tax returns of a variety of temporary visa holders, including the 457, in an endeavour to detect visa holders and/or businesses not complying with their visa or sponsorship obligations.

Thanks for the replies, and sorry for the slow response from myself, i've been busy doing a lot of work, and recently went to see an immigration agent with my boss for some advice....

 

We found that I can be employed in the business under a "Other Sports Coach or Instructor" (CSOL 452317), but another problem would be that I need to have 2 years of experience from home for this. I do have 2 years experience as a coach, although I was not directly employed by a company at home as a coach. I would coach people and charge them directly, kind of being self employed, although it was only on weekends, and not every weekend.

 

How deep would immigration go to be satisfied I had 2 years of previous experience in the role? I need to have a coaching qualification from Australia, which I have now obtained, but would I need to show evidence of the coaching qualification from the UK? would immigration call up the governing body for skydiving in the UK to check I had the qualification and that I was employed by a company in the UK for 2 years?

They would expect you to provide evidence, they do not expect to have to do all the running around for you. They would want tax returns if you were self employed. Your agent should have pointed out that the two years of work has to have been full time, so you do not tick the boxes there either. Your agent should have gone through all this with you. It is what you are paying them for.

Working somewhat casually on the weekends would not satisfy the two year work experience requirement. Also, DIAC wouldn't phone and check, what they would be more likely to do is request evidence to be submitted to them by you, and give you 28 days to do this. If after that period evidence was not forthcoming then a decision on your visa would be made based on what they had... it would likely be refused.
