457 Visa / TRA info for cook/chef...please help

Hi

Apologies as this is my first post.

My partner is a chef, qualified NVQ level 2 july 2011 through an apprenticeship and worked as a chef since 2009.

 

We have always planned to emigrate but know he needs four years and ideally wanted his level 3 NVQ, however, out of the blue he has been offered the role of Sous Chef with sponsorship.

The company have forwarded the certificates to their lawyers and havent mentioned TRA assessment.

What we need to know is - does he need an assessment or can they issue the visa without it? Does the fact that he is being offered sponsorship impact on the decision to grant the visa?

Any advice hugely appreciated

If he is being sponsored then he is getting an employer sponsored visa so not sure what you mean about this impacting the decision to grant the visa ... other than an employer sposnored visa without an employer sponsor would surely be declined..

It is not that common for skills assessment to be requested for a 457 visa, you can but wait and see if that is the case for you.

heres what the TRA say...am I right in reading that the UK doesnt have to have TRA assessments on a 457 visa??

457 is a work visa. Work visa not necessary to go for TRA assessment. However, your partner occupation have to match with his qualification.

If the employee ceases employment with the sponsoring employer, they are required to obtain another sponsoring employer within 28 days, apply for another type of visa, or they will required to leave the country.

thanks for the reply, were quite confident the employer can sponsor on this visa, they have done previously and no TRA is needed being from the UK and the position. We are waiting on the migration lawyer to email...life is firmly on hold. they want us there by the end feb which is just mind boggling....worried it all may somehow fall through so we have everything crossed.

Are you a Chef? if so Gumtree.com.au have loads of chef jobs - some that offer sponsorship :) good luck

Skills assessments are required for 457 Visa applications for some trades for applicants from certain countries. UK Chefs do not require one.

 

Shouldn’t your Lawyer be answering these questions for you?

 

The lawyers charge quite a lot for their time...just figured it was worth asking on the forum for that reason and also with the time difference it can take a while to get answers via email
