  2. As and when you win the AAT you get your visa straight away. You don't need to keep uploading new documents until the new CO ask for something.

  4. At the time of AAT the restaurant definitely needs to be a viable running business. If the owner decides to sell it, then the new owner need to carry on the business under the same ABN. The CO may change by the time your case is at AAT so it totally depends on them if they are satisfied with the documents that they have or want more documents to be convinced. Generally for AAT you need to provide more information and a through explanation.

  6. Hi Deoma this is totally depressing Oct 2016 is a long wait...many others have got it in 17 months as cook...is this due to the number of staff being sponsored by Ur restaurant or the turnover??

  11. Same here Smit... exactly same timeline applied for nomination and visa in Feb 2018. RCB approved in June 2018 from NSW. 12months waiting.

  13. Yes for sure as long as it's in ANZCO classification they will take your work experience and qualification as a whole. Please do keep us posted when you get your good news. I'm sure it will be pretty soon after you provide immigration with the requested documents. Good luck!!!
  14. Hi Daveyy, well if your case has been opened by the CO...it's good news for sure at least the long deadbeat wait is over now it's just a matter of a short wait. Now getting to your question - I had answered your question based on what is provided by the immigration website but you have to agree that there is a certain grey area which is not clarified and is left open to the case officers' judgement for example some visa's need to show 3years post study work experience after to your qualification when in reality the department only give you a 18 month to 2 year visa on post study work. Then the other example is when they ask for a certain amount of work experience but they don't specify if counts as part-time or overseas, so this is entirely the CO own interpretation. By the way for you it should be a straight forward issue since you can provide both the qualification as well as the 3 years work experience requested (I would resend all my work experience which in your case is more than 3years and a good thing...let the CO sort out and be satisfied rather than him assuming there's insufficient documentation to prove your experience) - so it shouldn't be a problem here and yes sometimes files do get corrupted and you get asked to send them again and again in different formats (this has happened to me 1st hand experience) it's quite frustrating but what else can you do.
  15. Davey your question is not clear enough. Firstly you haven't stated what Occupation you have filed your 187 visa. There are 3 different routes to the 187, let's say you are applying through DE (direct entry) in this case you need to show either 3 years full time work experience or a relevant Australian qualifications to your field (Note- only one is required of the two either experience or qualifications is enough to apply). Secondly the other pathways to 187 can count your overseas work experience as long as it is more than 3-5 years, your part-time work can also be taken in to consideration if you have worked legally for 20 hrs/week while studying and can prove it through payslips. Hope this answers your question.

If your court convections are related to speeding fines and demerits on your licence then you have nothing to worry about as long as you have paid the fines on time and have not been summoned to court due to evading fines...even if you lose your licence its fine but if you have been drink driving or hit someone with your car causing bodily harm or death then it can count as a criminal offence; however this can be properly determined by the nature of the incident, the police report and your policy insurance report - on certain instances based on your insurance companies report you may be deemed innocent.
  17. I think you should go for AAT. It's your last option so no harm in trying. The best option for you is to do your appeal by yourself instead of wasting more money through an agent or lawyer. The last time my visa was refused I had 28 days to lodge my appeal, read through the forms carefully and submit as much evidence you have targeting the main reason of refusal and explaining why you feel the decision should be reviewed and reversed. There is also a part in the form that says if you win the appeal would you like to claim 50% of your fee. I did this and from the $1608...I got back $804 back and my decision on my visa was overturned. Now the fee is $1764 you can apply for a 50% rebate initially but I would suggest you pay the full fee and get the 50% refunded after you win your appeal. Hopefully you will get your visa have faith and be positive .

Yes for sure you can wait....I'm telling you this from my personal experience, for my last visa we also printed out the HAP reference but due to my wife's pregnancy the Medical Testing place told us to wait...then 6 months later I reprinted new HAP references and never used the old ones. So as and when your ready you import your file on the immi website and reprint fresh HAP references...these new ones will still be associated with your file so there's nothing to worry about. Hope this helps.
  20. Hi Valerie it's best to wait for your CO to ask for the medicals and police clearance because if you apply now you will have to re-do them as they are valid for only 1 year. If you still want to do it then do it after 12-14 months
