    Hey @MP007

      Check your immi account, but you would more than likely be granted a BVA automatically upon lodging your visa application. The BVA will come into effect when your current visa expires.

    Sure there are a few exceptions, but sounds like a normal case...

    If you look at the date, that article is from 2013, and I believe they have scrapped that priority processing since then...

    Hey @Anh Bui

    that "Last Updated" box means the last time the department updated your application, so don't worry; your attachments are all uploaded if they say 'received', and the next time that 'last updated' box will change is when the department actually make a move with your application! Good luck!

    Is there any possibility for nomination refusal due change in sponsorship ? I have asked my MA but so far MA has not provided any information on this.

    It would be great if you guide me on this so i can take measure before department actually refuse my nomination.

    Parkesy has hit the nail on the head here...talk to you MA immediately.

    I had a similar thing happen....Nomination submitted, mid application the company made the ABN insolvent and started a new one for business purposes, I asked would it affect my application, HR said no...three months later, nomination refused.

    I would suggest you need to talk to your MA straight away, as there are 'change of circumstances' forms you can submit; and as long as the role is the same and the business is classed as an 'associated entity' then you should be fine, however you do need to action it ASAP.

    Hope this helps, and I really really don't want to make you stress as it sounds like your case is different to mine, however I would certainly start calling that MA of yours!

    Hey, as far as I know you can only check current visa. Someone correct me if I'm wrong

    No news / updates since then!

    ImmiAccount Status: received (for both nomination and visa)

    HR country with 2 people included in the application.

     

  7. that increase is huge, especially for DE...they should offer a refund of the fees if you applied and the waiting time increases by more than 20-30%. We all knew that the time could increase/decrease, but technically they could increase it to 4-5 years, and we wouldnt have any options other than to wait or leave empty handed. The increase is making me reconsider how much longer we stay here as second class citizens paying a first-class fare; NZ or Canada are looking more and more attractive. Shame

    Hey @KKD....I had a nomination refusal too, it literally turned my world upside down; wont post details here, but safe to say a panic attack or two later, I reapplied. My only bit of advise would be step 1. take some time to leave it settle and think about things. Emotions are running high, and any decision may have a little spite/frustration in it. Is this where you want to be etc etc. then, if you think you can handle another application, step 2. go to a personal migration agent for a consultation if you havent already, not one associated with your employer. Get all your options, not just employer sponsored. 

    I won't lie, the second application is harder...you know the possibility of a refusal, and it just adds to the anxiety of the wait. Feels like I've been waiting since last April!

    Either way, if I or anyone else here can help, just let us know; also keep us informed, as your misfortune might be able to aid someone else in their application. Thats why the forum is here in my opinion; support and advice

    I don't think it's a standalone form or anything, I think its one of those 'by submitting your application you agree that you intend to work int he position for 2 years', I dont remember signing a letter for it anyway....correct me if I'm mistaken please!!

    I would say its a pretty major issue...if they are in loss, then they will not be able to support you as an employee for two years, not even sure how they are paying your wage and super etc at the moment....so wouldnt meet the nomination requirement...I'd ask your MA, or if you dont have one, get one as soon as you can

    I've been addicted to this forum and my immigration account over the last 17 months...Way too much! believe me :)  It has been helpful sometimes but I've been also very upset when people provides misleading information or when people shares weird theories (example: Only unskilled people waits long time, only people who works for small companies etc etc

    this is mostly Bulls***** :) and very irritating to read :)   I guess,  this is just luck of the draw seriously 

    I can now enjoy my freedom and good luck to everyone, but especially to people who have been waiting forever.

    I keep my fingers crossed for the 2016 applicants!!!!!! :)

    The reason was immigration excuse, you may think I am being skeptical but it is true. Same financial information, only applied one month apart why one was refused and one was approved? I know from the BASs and IASs that were submitted the company I work for was in loss figure but again why refused one and approved another one. I do not think they have a clear guideline or benchmark, it will be depending on the CO's "Personal Assessment"

    I do not know the exact turnover but there is a minimum yearly figure that a company has to meet before EVEN approve as a sponsor. So once the company is approved then they can nominate. Do not worry too much man. If you want to ease your mind, ask someone who is handling the accounts in your company, see the BAS that were submitted for your nomination

    check the total amount that ATO owes the company against the total amount the company has to pay to ATO, plus if you have the latest superannuation statement from ATO portal. If those figures positive, I am 1000% that immigration cannot refuse your application on financial ground of the company.

    Anyway, I really need to know what you did after your nomination was refused, whether you reapply or appeal?

    Unfortunately yes, same boat....slowly sinking....and my bucket is slightly too small to keep me afloat! 

    So my case was a little different; the company changed the ABN, and despite me asking a million times would that affect my visa, they said no no no, it'll be fine...it wasnt fine. To be fair, I have to take some responsibility, as I should have checked with an MA instead of trusting them....but thats what seems to be a big issue around this forum, trust, who can you trust and who can't you. I didn't appeal the decision, and withdrew the application......that was painful!

    So I've left that company, as after that refusal they got a bit weird, and things didnt feel right, and I wouldve been lying to sign another doc saying I want to work there 2 years. So I've joined a very very small start-up.....theres just two of us...so we are cash positive and making a profit as we have very low overheads, all paid up to ATO, have a quality accountant who is looking after our books, but still, having such a low turnover in the grand scheme of things is a worry. I've seen all the BAS statements, and yeah....would be interested to see what that lowest turnover would be, as my MA didnt even mention it...If someone had an idea of that figure, it would be greatly appreciated. 

    But if I were you, I would of course follow the advise of an MA, as like it or not, they are the pros, we are just assuming and guessing the majority of the time, but from my amateur perspective, looks like you have good grounds for an appeal....I mean, the department has to show consistency, and not approve/reject depending on the mood of the day...

    The funny part is my work mate whose  application was prepared by me using the very same documents for the nomination was granted his PR last month.

    My MA said, I have option to reapply the nomination or contest the result to MRT. 

    I also can apply through skilled independent visa though, almost 3-5 years Australian work experience  Personally, I do not like work my current employer anymore. I'd love to change a job, but to find a company whose willing to sponsor me on 457 will take quite a bit of time.

    So, can anyone suggest?

    Ah man, really sorry to read this. I've had my previous nomination refused, and it is really really shit. The reasons they gave you are actually quite worrying, especially if a similar application was approved a month before, and the amount of staff you have. Definitely agree with other posts that it depends on the CO, but I also think we are seeing a shift in the rules of what the turnover needs to be in order to show that it can support an employee.....really worrying that your nomination was refused on that basis as my new nomination is with a small start up company, so trying to show that it will be able to support you is going to be tougher than a company of your size. 

    Also not sure how they can make that decision when you are actually employed in that position and the company are paying you....right? head-scratcher...

    By the sounds of things, skilled independent is the way to go. Keep us up to date though, as journeys like yours are the main educational part of this forum, even if it has lifted my anxiety level from 10 to 11.....!

    that same person has clearly decided to just go on a spreadsheet cleanse rampage ... over a month later! (As detailed in my post!) 

    Extremely frustrating....

     

    and just to further this; my companies nomination was refused and I had updated the spreadsheet with reasons for others to see....it was removed within a short period of time.....not sure why refused applications are removed, would be good to see reasons and dates, and how they align with shifts in policies instead of scrolling back through 1598 pages of posts. Also not sure if it is the same 'anonymous' couldve been another person.

    I wasn't going to reply @mjayy, but you've got me...

    So, unfortunately you are diverting from the misinformation and wrong answers you are putting to the forum and making it a tad personal at me and @ring3018, which isn't a great direction but I get it, defensive. Even in your insult you are still wrong which is hilarious.....the nomination was refused....why would I upload my personal documents to the business nomination? This refusal was pretty down-putting for me and my partner through no fault of my own, and I've come to the forum to help others through the knowledge I've gained, and also find a group of like minded people,  you don't seem to be one of them, but that's fine, I don't expect everyone to see things the same way. 

    Would you like to admit that the information you've put forward was incorrect? Or should we all trust the mighty mjayy who has been part of the forum for two months over the advice of a registered migration agent; if you dont have a 457 visa, withdraw your Direct Entry application immediately, and if you applied onshore and your Bridging Visa A has 'NIL' in the working conditions box, then immigration are lying, and you can still only work for previous 457 sponsor.....
