Alright I got a response from MA and it lines up with my reading this arvo.

    Not great news really:

I read up that even having kids/business etc is being rejected as 'compelling circumstances' and it's pretty hard to get past.

She suggested I give it 2 weeks and then considering if i want to apply for partner visa if haven't heard about 186 (457 expires 2nd march). 😩

Ah right! Yeah that makes complete sense, thank you so much for the info, it's really helpful!!

Crazy that having a child isn't considered compassionate circumstances; my partner and I have been discussing having kids, but that will put a hold on things until its resolved I think 😔

Lots of positive thoughts though, including a fresh bottle of bubbly in the fridge @Bellabonkers

If my 457 expires- I am no longer on a substantive visa. I have been told this means I cannot apply for another visa after 2nd March when bridging visa kicks in- should the nomination be rejected after this date.

As my occupation is high risk, and business small with neg turnover, its not a sure yes. I have been waiting 19 months now and was sure I would have heard by now.

I have been with my aussie parter 3 years now and is a more certain option, and so its been suggested to apply for this one before 2nd march, or risk it and wait for PR outcome. Tough decisions.

Hope this makes sense. If my agent is wrong,  I would love to hear it!

    Hey @maria8999

Just going back to this, I'm not 100% sure, but my understanding is you would be perfectly fine to wait out a decision on your 186 visa, if refused, then applying for the Partner visa. The immi website says:

"No substantive visa and have had a refused or cancelled visa

There are a limited number of visas you can apply for if you don't hold a substantive visa and:

    • you were refused a visa, other than a Bridging visa or refused on character grounds, on or after 1 September 1994 and since last entering Australia
      or
    • you were refused an entry permit and became an illegal entrant before 1 September 1994 and have not subsequently left Australia
      or
    • you have a visa that was cancelled on or after 1 September 1994

The visas you can apply for are:

    • Partner (temporary) and Partner (temporary) if, since last entering Australia, you have not been refused a Partner (residence) visa
    • Partner (residence)"

    See link to source below:

    https://immi.homeaffairs.gov.au/entering-and-leaving-australia/entering-australia/can-i-go-to-australia/check-if-visa-cancellation-or-refusal-affects-you

Again, would love to hear anyone else's opinion on this!

Hi Hex this is indeed true, this is a legal requirement to have private medical.

I saw many articles(even my own MA) says that you can cancel your private health insurance once you have received your medicare card.  So I was going to cancel it but before I did that I sent an inquiry to 457 VISA case officer and they replied in email that I cannot cancel my private health insurance even I got my medicare card, otherwise I will break my visa condition.

If you are on a 457, as far as I know - this is a legal requirement. (to have private medical)

    Hey Guys,

Not exactly true. I applied for 457 with a partner from Spain, I am Irish, and she had to get private health care, I didn't as Ireland has a Recip. Health agreement. See below link

As far as I am aware, if your nomination is refused, then you can still apply for the partner visa in the 28 days you have to respond while holding a bridging visa A. You then withdraw your visa application and the bridging visa A of the partner visa application then kicks in. This is my amateur understanding of things, l and would love to hear if others have been told or know otherwise!

I have a similar situation, where I'm being nominated by a small start-up who can't take on any big contracts, as if my application fails they would be liable to huge lawsuits for unfinished works, and be forced to leave go of staff under me.

Genuinely interested in peoples opinions on if you can apply for partner visa while on bridging visa!

Mid feb is the deadline my agent gave me.

My 457 expires 2nd march so I would need to submit before then. Hurry up Immi!!! over 19 months is enough me thinks.

    Hey @maria8999

Just wondering why the deadline at all? Why not wait it out until a decision and then apply with your partner if unsuccessful (it sounds like you are on the right track as docs requested etc). After your 457 expires you will just move onto a bridging visa, nothing would change really except you would have to apply to travel, which you will have to do anyway after March 2nd even if you apply for the partner visa! Seems like an unnecessary waste of money! (Plus a loooong Partner visa process, 2 years plus)

Any restaurant manager got approval recently?

Hey @Kashif.Iqbal , unfortunately I haven't seen any recently; just take a look back through previous pages, things have slowed down a little for all professions

My lawyer told me he is expecting big change in immigration this january.

Just wondering what this big change was, and whether your MA had insider knowledge, or is it just a rumor/hearsay?

Sorry guys, I'm new here. Where can I get the spreadsheet link to check out processing time for the ones that already got a granted Visa?

    My situation is

    Ocupation: industrial design

    186 transition applied: 02/11/2018.

    No of people: 2

Update: it haven't been opened as yet

It is only my impression or have the processing time being reducing since last year?

    Hey @Mariana!!

Finally, another Industrial Designer! You're the first other one I've heard of in the past 3 years, welcome!

I applied via direct entry as an Industrial Designer in Feb of 2018, just gone 11 months, and will keep you posted as might help you out with docs/timeline etc

    Good luck!

Hey @Kashif.Iqbal, just wondering what this was and whether your lawyer is privy to info from DIBP that others are not? Or just here-say?

Been following progress on here for last six weeks while on my first trip home to family in 6 years of being in Australia! Congrats to all those who received grants, and commiserations to those who received refusals; I've had one before so know how tough it is. I'm also applying with a start-up so a little worried this time around too...

@Bellabonkers I also had the same thought as your bottle of bubbly in the fridge as a way of positive thinking/law of attraction; the bottle of expensive whiskey is 2 more years mature due to the first refusal....but will hopefully taste all the better

good luck to all still waiting!

This is my opinion Based on conversations with my MA.

Before Xmas people who logged applications in jan, feb, March should see there visas processed or at least the nominations approved.

Hey @Friskycharmer that would be amazing!! I also spoke to my agent and like many before have said, there are a huge number of factors that determine the speed of the application, but two main ones: job title and company turnover. I'm skilled in a rare occupation (not another applicant on the spreadsheet) so that's a positive, but as my business is classified as small (less than 2 million annual turnover) that it will take longer. They told me not to expect to hear anything about nomination or visa until Feb-April next year.....but it would be a hell of a Christmas present!!

Hi all, my company changed ABN in July (We submitted TRT 186 earlier in year). It was more of a re-structure, not a buy out, same global parent company. I asked the MA how that would effect my application and she said it won’t. I’ve heard elsewhere though that having a different ABN to what was applied with does mean you have to re-submit again, does anyone know if this is correct, and how I should go about correcting my MA? She was very short with me too, got the impression she didn’t like me calling her direct line to ask her!

    Hey @BB86

Don't mean to raise alarm, but I had my visa refused in exactly the same way you have described. Lodged application, change of ABN with internal restructure, I asked whether this would have any negative connotations for the visa application, I was told no as it's the same parent company. Visa refused. If I were you, I'd ask for a second opinion, as I believe it could be ok if your MA proves that the new ABN is an associated entity of the old one.

Again, I'm no expert, would ask for a second opinion, but just wanted to share my story.

    [ Spouse Language Ability - Required? ]

    Hi,

I'm finalizing our visa application in immi and under the Attach Documents page, the Evidence of Language Ability is showing under the Required section for my wife:

    image.png.f2d09db7ad34519af421e0c562ebc49e.pngimageproxy.php?img=&key=578e852abf1eefa4

I thought this will be asked later? Should my wife take the IELTS exam before we submit the application or can we proceed with the submission?

    Hey @lastdrop

I'm not a professional, but I think you can apply and your wife can take the IELTS while your case is being processed if required (not required if she has a passport from a selection of English speaking countries, or is she went through 1 year of full-time education in English, check out the website for proof of English ability)

someone correct me if I'm wrong!

After not sleeping for 2 months and putting our house up for sale as we were convinced I was going home I received the golden phone call from my MA to let me know of my visa approval on Monday-the day after my son's first birthday 😀😀😀

p.s the immi website updated within an hour with my approval (I know because I was checking it 3 times a day!)

I wish you all the best on your applications and thank you for the advice I have received in the forum-some great people in here 😀

Guys just a simple question, I have submitted most of my documents via attached documents. there are some sections in attached documents which I personally think are already covered by Resume which I have already attached, like oversees experience and Australian experience, do I also need to attached resume in those sections again as it makes no sense to me. Kindly advise.

    Hey @galisuman

Be really careful, your CV is not evidence of work experience....you need to have employment contract, reference from employer, payslips or some other type of actual evidence, other than your word. An MA would answer this better that I could, I'm just letting you know my opinion.

    Hi,

I am new to this forum and I have few questions regarding my application:

here people are talking about two dates nomination and visa date, I am not sure about my dates, I had got following response from my MA:

"We are writing to inform you that your 186 visa application has been lodged on Thursday 15 February 2018. "

and then after 2 days we went for our medicals. So I guess my nomination and visa dates are same. Please confirm.

Also, I am from India, so I am not sure whether it comes under LR or HR country.

    Cheers.

    Hey @Sch

Your nomination would have been submitted on the same day or before the 15th of Feb, as you need to submit the nomination before the visa application. More than likely they are on the same day, but nobody can confirm other than your MA.

Unfortunately India is currently a HR country, but don't be disheartened by that, you will assessed on your merits and hopefully get your PR soon regardless of where you come from.

Thanks, Skill Assessment and PTE is positive. My employer's immigration agent quoted as below  "You may want to consider that, according to Immigration the average processing time for a Subclass 186 ([DE) Visa is between 13 – 18 months, whereas the average processing time for a Subclass 186 (TRT) Visa is 12 – 13 months."

On the contrary, 2 of my friends got 186(TRT) visa in 4-5 month and one friend is stuck with 186 ([DE) from last 10 months. So again, Shall I wait another 6 months to get eligible for 186(TRT) or apply 186 ([DE) right now.

If you are really comfortable in your position and time is not a factor, I would wait and apply TRT, just feels safer. But if you want it ASAP, then DE should be just as secure if you have a positive Skills Assessment and PTE.

Everyone here can give you different opinions on the info provided, but at the end of the day, nobody knows your situation like you do. Go with what feels right, probably not what you want to hear but trust your gut.
