Crazy that having a child isn't considered compassionate circumstances; my partner and I have been discussing having kids, but that will put a hold on things until its resolved I think Lots of positive thoughts though, including a fresh bottle of bubbly in the fridge @Bellabonkers

Hey @maria8999 Just going back to this, I'm not 100% sure, but my understanding is you would be perfectly fine to wait out a decision on your 186 visa, if refused, then applying for the Partner visa. The immi website says: "No substantive visa and have had a refused or cancelled visa There are a limited number of visas you can apply for if you don't hold a substantive visa and: you were refused a visa, other than a Bridging visa or refused on character grounds, on or after 1 September 1994 and since last entering Australia or you were refused an entry permit and became an illegal entrant before 1 September 1994 and have not subsequently left Australia or you have a visa that was cancelled on or after 1 September 1994 The visas you can apply for are: Partner (temporary) and Partner (temporary) if, since last entering Australia, you have not been refused a Partner (residence) visa Partner (residence)" See link to source below: https://immi.homeaffairs.gov.au/entering-and-leaving-australia/entering-australia/can-i-go-to-australia/check-if-visa-cancellation-or-refusal-affects-you Again, would love to hear anyone else's opinion on this!
  4. Hey Guys, Not exactly true. I applied for 457 with a partner from Spain, I am Irish, and she had to get private health care, I didn't as Ireland has a Recip. Health agreement.   5. As far as I am aware, if your nomination is refused, then you can still apply for the partner visa in the 28 days you have to respond while holding a bridging visa A. You then withdraw your visa application and the bridging visa A of the partner visa application then kicks in. This is my amateur understanding of things, l and would love to hear if others have been told or know otherwise! I have a similar situation, where I'm being nominated by a small start-up who can't take on any big contracts, as if my application fails they would be liable to huge lawsuits for unfinished works, and be forced to leave go of staff under me. Genuinely interested in peoples opinions on if you can apply for partner visa while on bridging visa!
  6. Hey @maria8999 Just wondering why the deadline at all? Why not wait it out until a decision and then apply with your partner if unsuccessful (it sounds like you are on the right track as docs requested etc). After your 457 expires you will just move onto a bridging visa, nothing would change really except you would have to apply to travel, which you will have to do anyway after March 2nd even if you apply for the partner visa! Seems like an unnecessary waste of money! (Plus a loooong Partner visa process, 2 years plus)

  8. Hey @Mariana!! Finally, another Industrial Designer! You're the first other one I've heard of in the past 3 years, welcome! I applied via direct entry as an Industrial Designer in Feb of 2018, just gone 11 months, and will keep you posted as might help you out with docs/timeline etc Good luck!
  9. Hey @Kashif.Iqbal, just wondering what this was and whether your lawyer is privy to info from DIBP that others are not? Or just here-say? Been following progress on here for last six weeks while on my first trip home to family in 6 years of being in Australia! Congrats to all those who received grants, and commiserations to those who received refusals; I've had one before so know how tough it is. I'm also applying with a start-up so a little worried this time around too... @Bellabonkers I also had the same thought as your bottle of bubbly in the fridge as a way of positive thinking/law of attraction; the bottle of expensive whiskey is 2 more years mature due to the first refusal....but will hopefully taste all the better good luck to all still waiting!
  10. Hey @Friskycharmer that would be amazing!! I also spoke to my agent and like many before have said, there are a huge number of factors that determine the speed of the application, but two main ones: job title and company turnover. I'm skilled in a rare occupation (not another applicant on the spreadsheet) so that's a positive, but as my business is classified as small (less than 2 million annual turnover) that it will take longer. They told me not to expect to hear anything about nomination or visa until Feb-April next year.....but it would be a hell of a Christmas present!!

  12. Hey @BB86 Don't mean to raise alarm, but I had my visa refused in exactly the same way you have described. Lodged application, change of ABN with internal restructure, I asked whether this would have any negative connotations for the visa application, I was told no as it's the same parent company. Visa refused. If I were you, I'd ask for a second opinion, as I believe it could be ok if your MA proves that the new ABN is an associated entity of the old one. Again, I'm no expert, would ask for a second opinion, but just wanted to share my story.

Hey @lastdrop I'm not a professional, but I think you can apply and your wife can take the IELTS while your case is being processed if required (not required if she has a passport from a selection of English speaking countries, or is she went through 1 year of full-time education in English, check out the website for proof of English ability) someone correct me if I'm wrong!

Hey @galisuman Be really careful, your CV is not evidence of work experience....you need to have employment contract, reference from employer, payslips or some other type of actual evidence, other than your word. An MA would answer this better that I could, I'm just letting you know my opinion.
  17. Hey @Sch Your nomination would have been submitted on the same day or before the 15th of Feb, as you need to submit the nomination before the visa application. More than likely they are on the same day, but nobody can confirm other than your MA. Unfortunately India is currently a HR country, but don't be disheartened by that, you will assessed on your merits and hopefully get your PR soon regardless of where you come from.

  20. If you are really comfortable in your position and time is not a factor, I would wait and apply TRT, just feels safer. But if you want it ASAP, then DE should be just as secure if you have a positive Skills Assessment and PTE. Everyone here can give you different opinions on the info provided, but at the end of the day, nobody knows your situation like you do. Go with what feels right, probably not what you want to hear but trust your gut.
