Hi Ginni,

 

Application and Nomination lodged 15 November 2011 in Perth.

 

WP you have to make a inquiry from Perth they are already processing,

"The Perth Centre of Excellence (COE) RSMS cases which were received on 4 January 2012."

Something may be missing like your proper contact info

I still got visa until feb 2013 I just come back we have business in my home country. So then my MA told when u r applied for 119 u have to be offshore. I am just waiting bcz I don't want to waste money on ticket any more.

You do not have to be out of country for RSMS 119 lodgement only at the time of visa grant purposes.

one of my MA's client application was declared "invalid" just because he was onshore at the time of lodgement 119

 

DIAC declared Invalid under section 48

There must be something more to the application being declared as "invalid"... there have been so many cases on people applying for RSMS 119 and are onshore and when CO's are ready to grant the visa.. they have been sending out pre-grant letters informing the applicant to exit the country so that the visa is granted whilst off-shore...

 

I have also applied for 119 visa, I am onshore... working for my company for the past 2yrs now...

Agree, there is nothing at all to say you have to be out of the country when you apply.

This application has been declared invalid because application was onshore at the time of lodement under sec 48 that's all I know at this time when I have more info I will post it here

Why somebody have to apply for 119 visa while onshore not 857 visa. What are the conditions like substasive visa or..... Can sombody clarify?

HE must be refused other onshore visa. The section 48 is to prevent people to apply a new visa when the people still onshore

You just need to make sure you do not have section 48. Just this, doesn't matter any kind of Visa you hold. I apply 119 in Australia. Don't worry.

yes you are right i just find out he was refused onshore 485

 

 

A person who does not hold a substantive visa (a visa that is not a Bridging visa or a Criminal Justice visa) and has had a visa refused or cancelled since their last entry to Australia is prevented by section 48 of the Migration Act from applying for another visa while in Australia, except for certain prescribed visa classes.

From 14 September 2009, these people may now be eligible to apply for a Partner visa in Australia if they meet certain criteria. They must not have had a visa cancelled or refused on character grounds or have had a Partner visa refused since their last entry to Australia, and they must provide with their application:

as a student visa, u can apply onshore RSMS 857 as long as u already graduate/finished the course on ur current student visa or u r holding a graduate visa which is 485, but if u applied for another school provider and u have yet to finish the course on ur current student visa then you have to be offshore.

Please see below for the current up-date from DIAC on the RSMS/ENS processing times:

It would appear likely that the pre-1 July rush of applications has added around 9,000 applications (about 20 to 21,000 persons) to our pipeline. We are still entering cases on to our system. This moves our on-hand caseload from being the equivalent of 4 to 5 months processing work, to around 9 months of work.

*

Clearly this has potentially serious implications for service standards. This is especially so for cases in our pipeline. The priority offered to 'decision ready' applications already meant that pipeline cases actually were taking more than 4 to 5 months to allocate to case officers. A 9 month pipeline therefore has potentially significant issues for pipeline cases.

*

At the same time we have a mass of decision ready applications on-hand. Up until now we have been able to balance their allocation with the allocation of cases from our pipeline. At the moment we do not have enough case officers to allocate all decision ready applications in the previously nominated timeframes. In fact it is likely that it will take several months before they are all allocated. At the same time if we only processed decision ready applications this would be a further problem for the timeframes associated with allocating pipeline cases.

At the moment we are working on trying to strike a balance.

*

We hope to shortly again to be in a position to include on our mailbox auto response the dates of lodgement we are up to with allocating cases from our pipeline.

For several reasons we don't think we will be in a position to say where we are up to in terms of date of application with decision ready applications. In some respects the dates will be meaningless because we received so many applications over such a short period.

So all decision ready applicants have to wait a bit longer than usual.

 

Hi Friends,

So what about those who already have case officer for last 5& 6 months? Like me. Immigration also visited on my workplace 20th june but still not any decision. I am going back to my homecountry 10th of August because my student visa is expried and can't extend because already extended two time. I applied offshore 119 DRC at melbourne.

visa + nomination 12th Dec 2011

nomination approved 9th of march 2012

immigration visited on workplace 20th june and required some docs

already submitted to immi

Now waiting

our MA contact to CO on 4rth of May 2012 and he said he is processing my file not ready for decision yet and also said don't send any progress inquery email to me regarding application once i get decision inform to you.

 

Now 3 months passed no any response even than immigration visited workplace but no response yet. so we cannot ask about my application.

 

Now selling stuff and booking tickets to be offshore bcz have not any visa more.

 

Lots of stress at this situation. My daughter don't want to leave school and going back home country but we have to go.

I am not sure we will come back Australia or not?

 

Any suggestion will be appericated

I hve got surprising news this morning one of my friends in

Gladstone

 

 

qld applied 119 visa just on june 28th they never received ack but they have got mail from IMMI on wed. asked to pay fees as her hubby haven't done ielts they paid fees on same day and now CO asked them to leave country so he can approved there visa,now they going out of OZ today ..... .at the moment I hve just this info. might will hve more on monday as we hve same MA

Hi veenameena try to extend your student visa being offshore you won't be able to appeal in case if you get negative decision on Ur application

They do say you can contact them if your current visa is due to run out in the next couple of weeks. Good luck.

Where is anything saying that you have to be offshore if you are part way through a course or have started a new student visa? Do they add the no stay clause for a second student visa? I don't get why this would be the case as long as you fit the criteria otherwise, and it is something I have never heard said before.

He applied 857 onshore to diac and diac send his application back to him bcz he is on student visa bcz when he completed his 2 year diploma he could nt get ielts score for 485 visa then he applied another one year course and got student visa. Now his study is going to finish in dec. and he has to applied 119 offshore.

just a quick update on the timeline guys... rang DIAC on Friday and got told that they have assess my medicals... hopefully not long now...

I asked if I got assigned a CO which they replied no... any ideas on how much longer I need to wait? 857 onshore and I got the acknowledgement in mid June. Parramatta office...

Hi blossom I wanna just like to share something about my friend. He applied 857 onshore to diac and diac send his application back to him bcz he is on student visa bcz when he completed his 2 year diploma he could nt get ielts score for 485 visa then he applied another one year course and got student visa. Now his study is going to finish in dec. and he has to applied 119 offshore.

 

This must have been because the new visa they issued him had a no stay clause. There is nothing at all to say that if you are on a student visa you have to be offshore, infact I know people who have applied while on a student visa, and myself had an agent who said I could apply for a rsms, only 6 months into my two year course. That didn't work out for a whole other set of reasons. But anyway, that will be because of the visa he is now on, not to do with when he has done his course.

We finished doing the medicals with my family and the

results are here with me,....just asking if we could

submit it even if I not yet allocated with CO.

Btw,I had ack letter emailed last July 14, 2012....
