We are looking at moving back to the UK but as we are both fairly low income earners we need assistance to cover the cost of child care. Our child was born in Australia. You would need to apply for child benefit reference numbers to be able to claim and you would also need to be able to legally have access to public funds to be included in the claim, which means the correct visa. Some people 'pass' the habitual residence test in a matter of weeks, others it can take a year. It is quite a complicated test and no set rules depends on the view of the person assessing. But proving you are going to live in the UK, have not arrived just to claim benefits and have no intention of returning to Aus will be part of it.
