We are still in UK but when we move OH will still be in the same job. He works in Africa and works 28 days away and 28 days home. There will also be days he will be travelling there and back - usually 2 there and 2 back.

This means that he is out of the country a lot more than he is living there.

Does anyone know what his Tax situation would be? Just now he does self assesment and pays Tax once a year. I have been on the ATO site but couldnt find an answer only about Tax agreements with other countries.

Many thanks if you can help with info.

Mandy

Hi Mandy

To be honest, I wouldn't go on information that you get from here on this one. As what could be the case for one person may not be the case for you due to other potential factors.

I would say that you should seek specialist tax advice on to ensure you get it right straight away.

Alan Collett on here may be just the man.

On another note, where abouts in Fife are you from? I lived in Upper Largo for a while and still have family in Glenrothes.

Thanks Andrew

I just thought that somebody else might be in the same situation and could help. Hubby thought he would wait until he got there before seeing someone but I like to be organised so will give Alan a phone for advice.

We are in Pittenweem - Hubby been here all his life, lovely area but its time for a change lol

Mandy.

Hi Mandy, just seen your post I'm not on here much and will be less so now that tax season in kicking off.

For the exemption from Australian tax to apply (for a PR resident visa holder/Domicile in OZ) foreign employment must be for a continous period of 90 days or more.

If you hubby is only away 28 days each time being broken up by a return to Oz, then I would say that he would have to declare that income but may be able to have a credit offset for any tax paid there depending on the nature of work. Sounds a bit complicated, but so is the Australian tax ! Have a look at this link systemhttp://www.treasury.gov.au/documents/1364/PDF/SA_tax_treaty.pdf

Hope this helps

Mandy,

Do not take "advice" from anybody on here, no matter how well intentioned. It could end up being the most expensive advice you've ever received.

Australian tax law is about as convoluted as you can get.

Allan Collett is a Chartered Accountant as well as a RMA. Be guided by him.

If you need a further referral to an Accredited Tax Law specialist send me an email.

Cheers,

Les

ooh Les I get your point but you could have made it easier on me, I am a qualified Tax Consultant, but yes everyone should get specific tax advise with all the correct information to hand so that the Tax prof can give specific advise to the individuals circumstances.

I don't think I will post on here anymore on tax issues it seems that you migration agents are very quick to snap. It was only an answer to a question ansked, I thought It would be helpful, I don't charge?

Signing off Cheney
