She relocated to India but her ex didn’t let her take the child to India. So she lost the Custody. We applied for 309 but co is asking for child medical check. We talked to my wife’s ex husband but he is too abusive and said that he will never take the child to medical check. If he responds to an email saying he refuses to assist, then she could provide that email to the CO in hopes that will be sufficient to waive the requirement.
