187 visa - redundancy

Hi all, 

Melon story but my partner was employed by a company and sponsored on 187. His HR team screwed up the application and it went to appeals because they didn’t provide enough information. We have HD the heating and the case has been remitted back to immigration to process as the appeals are satisfied we meet all the criteria. He has been in the job for 2 and a half years, we have been on a bridging visa the whole time but he has worked for the “sponsored employer”. 

Today he was made redundant by his employer and we do not yet have a decision from immigration, although it will likely be a yes because we met criteria for appeals. 

Has anyone had experience of this? As he has fulfilled his obligation with to work for the employer for more than two years does this mean our visa can still be accpeted and he can work for another company? 

Can he work in a non regional area if we are granted?

2 years requirement applies from the day ur visa approves. But if u have visa approved then ur employer make redundant then its not ur fault. U r still safe.

As u mentioned the case already remitted to immi from AAT it is likely to be approved.

Could u please share ur timeline?

It states that the company is not obliged to let Immi know of any changes to circumstances. 

We applied for the visa in jan 2016, it was rejected 18months later because the employer failed to upload my partners skills assessment. We appealed, had a hearing in June with the appeals tribunal who have remitted the case back to Immi and now we are waiting for official answer from Immi. However he was made redundant this week. 

If it is approved we can then say he has been made redundant and hopefully keep our PR because he worked with them for over 2 years?

I think you need to consult a registered agent ASAP. I don’t think they can grant a 187 for a job that no longer exists.

 

It’s very confusing. I’m hoping we will be ok.

How did it ended up? are you safe in oz?
