457 Problems....

Hi all.

 

So my employer had been employing me on the 457 visa but now iam on the 190 state sponsor visa... However the employer failed to meet a couple of obligations whilst i was on the 457, i was not a full time employee and on a casual role which i should be full time under the visa conditions and i wasn't paid any holiday pay or paid annual leave, again i should of been paid both.

 

The problem i was faced with was the fact that the owner of this company is violent, aggressive and unpredictable bloke who likes to bully and stand over people and it was making it so difficult to approach him about this matter and i was very unsure on if to contact the dibp as there was a fear of the visa being cancelled.

 

Now I am on the 190 visa and have no ties to this employer i feel that i should be raising this concern with immigration, not only for my self but for any future employees on a sponsor with this company who may find them selves in the position i was and not confident enough to notify the dibp.

 

Has anyone else encountered problems such as these and if so what course of action did you take ?

Thats what i was thinking, but at the time i was placed under such fear of losing my job i didnt know what to do. Ive literally just been speaking with my partner about this, now iam no longer tied to this company i feel confident enough to raise the issue with dibp

But could your disclosing this information affect your current visa in any way? As in if you or your employer lied on your application or some such for your 190 or the 457, could it cause problems for you or see your current visa cancelled?

 

I don't know if it could be the case but before you do anything I'd research things fully. I'd not do anything until you are fully informed.

Fairwork Australia is where you take it if you want to persue it, but I'd be thinking about what this might actually gain. However if the company owes you holiday pay etc, I'd be tempted to write a written letter of request for it, stating your rights. It might work but if it doesn't I'd not persue it for the reasons mentioned in the posts by Snifter.
