Advice desperately needed for an EXPERT MIGRATION AGENT to help with subclass 189 and 190

I applied for both 190 and 189 subclass under the instruction of my agent to gain the best chance of being selected. They failed to tell me until the end of the process that IT and Accountancy are the two hardest occupations to get in on the 189 and that the chances of being accepted on the 190 are low due to the small number of invitations, along with other factors such as recent work experience.

 

I did have 65 points for the invitation round on 27th April 2016, but I have now turned 33 years old and therefore lost 5 points. My EOI would have been lodged back in February 2016 had it not been for the IELTS examiner incorrectly marking my speaking exam, which I had to appeal and wait 2 months on. I am an English citizen from birth. That has basically stopped me being invited for my visa because the cut off was on 15th March 2016 for that invitation round with 65 points required for selection (which I had). Apparently the 'pass mark' has been 65 for the past few months, I was never told this before either and thought with 60 I would have a good chance going forwards. I have had the worst luck with my application, the most painful year and experience of my entire life!

 

My agent has blamed it all on me. Apparently it is my fault for not taking further IELTS exams (requiring level 8s), while I waited on my appeal. This would have been ridiculous, as I was in a strong position for this appeal, I knew it was a clear error by the examiner and I was upgraded from a 7.5 to a band 9 and refunded my appeal fee. I would love to name and shame but I won't, for now.

 

Can anyone please recommend a GOOD Migration Agent/Agency who might be able to help me with this awful situation?

I have also posted a letter off to the DIBP in Melbourne to appeal my situation because obviously my chances have been ruined by the IELTS examiner! I hope that they can see this, I have included both my IELTS certificates showing the change in score. Any other advice would be much appreciated.

I am not quite clear what help you are after. You have done skills assessment, got the 9s needed for top marks in IELTS and now just need to wait for an invite? I am not sure what you think an agent can do about it. What are your points with the new IELTS grade, is it 70?

The OP now has 60, they did have 65 but lost 5 when turned 33.

 

It sounds like your agent hasn't been as transparent about the situation as you would have expected. However, if they gave you advice at the time to resit IELTS whilst waiting for your appeal, and you chose not to, then that was your call. You must have known that you were going to turn 33 and would lose points, so time was of the essence? You also would know that an IELTS remark can take 8 weeks (a quick google just gave me that info) So if you chose to hold on for the 8 weeks of the appeal, knowing you were soon to be 33 and lose 5 points, and the agent advised you not to, I think you've got no complaint towards the agent, they gave you their professional opinion and you stuck with your principles, confident of an upgrade at the remark.

If your IELTS appeal has been successful, you should be up to 70 points now? That would put you in a strong position for an invitation under an ICT occupation in the next invitation round. As posted above, if you were concerned about the timing I would have gone ahead and redone the IELTS rather than wait for the appeal.

I dont believe the agent has been very transparent with you, going only by your statements but I do not believe the points predicament you are in is their fault. As a previous poster explained very well, you knew you were turning 33 soon, you also knew an appeal would take upto 8 weeks and your agent advised you to resit the IELTS but you chose not to. There is nothing ridiculous about the agent telling you to retake it, people take IELTS and PTE exams a number of times to improve their scores.

 

It's good you got a positive reply on the appeal but what's the point now? You would not be in ANY predicament had you just sat another exam and forked out for an additional test. It's good to be principled but sometimes you need to be practical about your situation and not gamble so much. It is very unfortunate for you and I hope things work out but please bear in mind that you got yourself in this predicament and not the agent. I am not sure what another migration agent can do but there are a lot of them on this forum who could advice

Can't argue with that. The current agent gave exactly the right advice.

 

I still really do not see what a new agent can do to change the situation. The OP must now have 70 points so the invite will be along soon I expect.

I'm generally just more confused about why the OP mentioned both IT and Accountancy... Both pretty different fields. If you've 70 for accountancy, you'll be fine (but I understand all accountants tend to have pretty lengthy waiting times); if you've 60 for any IT field, you might have a few months wait (as long as you're not a business analyst, but don't get me started on whether that's even IT - I'm a developer and architect by nature), but the invite should hop along in due course.

 

Just find it interesting that someone could qualify for both distinct fields.

I just want to clear up a few things here, as people are becoming confused. I turned 33 on 5th May 2016 and now have 60 points for occupation Developer Programmer. I was never told about there being a 'pass mark of 65', just that I needed to achieve 60 points for the 189 visa. After getting my IELTS appeal, I had 65 points and therefore thought I have done very well and would be well along the way to being invited. My agent even congratulated me at this point. Along with the fact I had 65 points for the invitation on 27th April and still it wasn't good enough!

 

I received my INCORRECT IELTS exam result back in early February 2016. Therefore, even if I had taken the next IELTS exam in late February and managed to score level 8s (which is damn hard - it took me 3 attempts), after waiting 13 days and allowing a few days for the certificate to be posted through, I would have been struggling to make the cut off date of 8th March for 23rd March invitation round:

(Correct link despite the incorrect date. This is the round I had 65 points for but didn't make the cut off. I hope this explains my situation better, it is all incredibly complex and distressing).

 

 

I am just disappointed that I was not informed earlier of all these things because I could of planned my application better had I been told the critical details of the application process back in the beginning of the journey, such as a 'pass mark' for the 189 and that the chances on a 190 are low. I think from what I have been told, the process has been tightened right up over the past year, especially for the 190 selections. I'm guessing that a year ago when I began all this, I would have got in OK with the points I have now!?

 

CiderDrinkingCoder.. do you also have 60 points as a Developer Programmer for the 189? Thanks again guys for your comments I am new to this site.
