Validity of PR dependant visa after divorce

Hi,

 

Posting this on behalf of a friend.

 

She has PR visa as a dependant of her husband who is on a 189 visa.

 

They have made their first entry and she was due to join him in Australia soon. Unfortunately, they are now divorcing - is she still able to move to Australia as a permanent resident?

Yes. Once granted each applicant has their own visa.

What at about the fact that PR was granted on her marital name, which is the name on her passport, and she will now probably revert to her maiden name?

 

No problem. She will need to notify everyone (banks etc) of her change of name - just the way she did when she got married.

 

She should apply for a new passport in her maiden name as soon as the divorce comes through - if she does that within the first twelve months it's free.

She can call herself anything she likes as long as it matches the supporting documentation. So if she gets a different name in her passport (therefore a new passport number too) she needs to update her visa with the new details on form 929 (or online through her immi account).

As others have said it's not a problem. The PR is granted to the person not the name or the passport number. Now obviously they have to use the name and the passport number to recognise the person has PR so there's a procedure (form 929) so IMMI are updated but it's just a matter of telling them the information it's not a new visa application.
