Well actually I started off by going to the Aus Visa Wizard online

My answers

1. Why do you want an Australian visa?

To work (includes permanent migration)

2. What is the country of nationality on your passport?

United Kingdom

3. Where do you expect to be when you apply for a visa?

United States of America

I am a dual UK/US citizen, but currently only hold a UK passport.

4. What is your date of birth?

20 November 1981

5. How long do you intend to stay in Australia?

Permanently

6. Do you have any of the following sponsors?

No, I don't have a sponsor

No but my brother is currently on a 457 visa, he is looking to maybe apply for PR later this year.

7. Is your nominated occupation on a Skilled Occupation List (SOL)?

Yes

It doesn't say my occupation should be on SOL 1 but my occupation is found on The State And Territory SOL (Schedule 1 and 2)

313112 TRA Skilled Occupation List (SOL) 2011 - Schedule 1 and 2

8. Have you completed 2 years study in Australia in the last 6 months?

No

9. Do you currently hold any of the following visas?

No, I do not hold any of the above visas

10. Have you completed an Engineering degree in the last 2 years at a recognised university?

No

11. Are you a medical practitioner?

No

and based on my answers above, the only visa applicable to me would be the Skilled - Independent (Migrant) (subclass 175) visa

What would be my next course of action from here? Find a a sponsor that can sponsor overseas IT Technicians? I think that is impossible.

Hi Bubbe, if you are applying for a 175 visa, you do not need a sponsor. That is why they call it "independent". However, with the looming deadline of July 1st, from which date "skillselect" rules, kick in, you should really be fast on the draw to meet the exisiting criteria which include getting a skill assessment done for your ANZSCO (SOL1 occupation applicable to your case). Or else, go for the new rules and start the research on Skillselect. All the best !

I don't understand why you are wondering if you should look for a sponsor, what is wrong with the visa wizard suggestion of Subclass 175?

By the way, you need to know if your occupation is on schedule 1 or schedule 2 - if it is only on schedule 2 then a 175 is not an option, but a 176 may be.

Guest imigrate Australia

Realistically I would doubt you have time for a 175 visa - check with your assessing body what their backlog is, given the changes.

No sponsor needed for a 175 ....

.... but an Employer Sponsored Visa may be a good route for you to pursue - its the Governments preferred route and Skill Select will be aligned to moderating the targeted skills coming in to the country. Its not impossible, but you have to be very targeted yourself to secure a sponsor. Hope that helps.

Tip to the wise- don't put your date of birth on here- The visa wizard is not so helpful it really requires some investigative work on your side. I would also suggest as others have that you look to see if you have a skill which would attract sponsorship from a state - if I were you given the time frame in that things are changing in July I would look at the new Skill select program on Diacs web site. If in the future your relative becomes a permanent resident and you are willing to wait and would still meet the points test then you could be sponsored by them and if you have a skill that is wanted there will be a route to explore. It looks like some choices will need to be made somewhere down the line as i am not sure that you can hold citizenship for more than 2 countries if you apply to OZ.

there is a cap and WA publish their list each month - if you explore the site further you will find research as to whether there is an ongoing demand for your skill or whether it is flagged to be removed. The cap is relevant to each year so will change again in July as new places are allocated.

If WA is the place you want to go for def i would then look at the skills assessing body to see if you can meet their requirements and look at how long it is likely to take!

this is the link I went to also:

http://smconline.dtwd.wa.gov.au/

my occupation from the drop down menu was not greyed out, others I saw said besides it that the quota had been reached.

Also, UK PP holders still have to get an IELTS right?

and one more thing, further reading the http://www.migration.wa.gov.au/SKILLEDMIGRATION/Pages/HowtoapplyforStateSponsorship.aspx link

it says

[h=2]Criteria for off-list nominations[/h] Off-list places will be offered to applicants who meet the criteria set by the Department of Immigration and Citizenship (DIAC) for General Skilled Migration as at 1 July 2011 and can provide evidence of job opportunities in their nominated occupation in Western Australia. Evidence for State Sponsorship can be provided in the following ways:

  • tentative job offer from employer/s (ie willingness to interview an applicant if they are successful in being granted a visa); or

  • evidence of at least three employment opportunities in their nominated occupation in Western Australia. This includes online job websites and newspapers.

so even if I am unsuccessful in applying for WA sponsorship before the major change in July 1, I can still apply after July 1st for WA sponsorship by submitting job ads online that there are IT ooprtunities in WA?

The whole process is confusing.

So I know that my occupation is on the WA occupations list, and in order to apply for the subclass 475 visa, I need to have a positive skills assessment done by TRA. I go on the TRA website but my ICT occupation is not listed. None of the TRA programs applies to me because ICT is not there??

Someone please advise.

thanks

why do you think this? your skill is still on the current list so you can apply but you would need to get your skills assessed!

I would suggest go back the trade web page and have another look as this is the assessing body http://www.immi.gov.au/asri/occupations/i/ict-customer-support-officer.htm#SKIA

http://www.deewr.gov.au/Skills/Programs/SkillsAssess/TRA/Pages/default.aspx and look at the permanent offshore migration info

refer to http://www.deewr.gov.au/Skills/Programs/SkillsAssess/TRA/OffshoreAssessment/Documents/OSAPGuidelines.pdf

and also refer to http://www.abs.gov.au/AUSSTATS/ABS@.NSF/Product+Lookup/1220.0~2006~Chapter~UNIT+GROUP+3131+ICT+Support+Technicians to show which skills/tasks you should evidence in your application.

neither is it an off list skill, its on the list!

My advice is to slow down and try to understand the process - look at book 6 on Diacs web site

with regard to IELTS you have to make a decision as to whether you need extra points as you already have a uk passport, so dont always need to do this test http://www.immi.gov.au/skilled/general-skilled-migration/pdf/points-test.pdf

if you are getting confused and you cannot find your way through this info to make any sense of the process you may wish to consult a migration agent to help which will cost- if you are trying to beat the deadline when everything changes to skills select and when you will only be able to apply by invitation only then you are cutting things extremely fine!

the process is to look at the points test and find out if you can actually meet the points test first and if not decide what you need to do next

apply for your skills assessment -you can search this site to find out how long this takes people to obtain

book your self in for ielts and sit the test if you need to then apply for state sponsorship with WA

if you are willing to wait for the July deadline and will still be able to obtain 65 points without being too old and loosing points etc then you need to look at the skills select

I would email them they will get back to you -it is not the TRA who have the quotas they are just the assessing body and will assess whether or not the occupation has been capped, as I am not an IT specialist I did not go down this route myself- let us know how you get on best of luck
