  1. My agent just completed the AAT appeal form and submitted, didn’t give any documents with it. Because our original file which contains all the documents from Immigration will be transferred to AAT. So waited till they open the file... when they opened in March 2019, they asked for further information (I don’t know what documents, coz my agent and owner only dealt with it, since it’s Company’s Confidential Documents) After they requested only, my agent submitted the documents.
  2. I applied for AAT in January 2018, it took 14months for AAT to open my file, so they opened on the 20th of March 2019. Then they requested few documents, we submitted them on or around 5th of April morning time via email, same day around 1pm AAT Approved the Nomination straightaway. They didn’t invite us for a hearing or anything. AAT Officer Approved the Nomination after looking at the submitted documents and my agent’s strong argument.
  3. Hey DDL... for me Case Officer didn’t ask for 3 years experience, he asked to prove my Overseas Qualification is equivalent to atleast a Diploma Level on AQF Level. So for that I did RPL to prove it. Also Immigration cannot ask such thing from me, because I lodged my Nomination and Visa in 2016... Hope your case is that you applied for your Visa after March 2018, that’s why Case Officer is asking for 3yrs Experience, coz after March 2018 they put a condition as min 3yrs experience required.
  4. Yes the Business is currently running, Director/Owner is not working... The business opened in mid 2015. I joined end of 2015, and applied for RCB, NOM and VISA starting July 2016... Then we got the Nomination Refusal in December 2017, VISA Refusal in February 2018. Applied for AAT in Jan n Feb 2018 (Nomination and Visa). AAT requested more documents in March 2019
  5. I had the same Document Request from Case Officer. My MA suggested to do an RPL for my Overseas Qualification. So I did RPL and submitted on the 9th of May along with other documents. Still nothing from them....
  6. Sorry to hear that... looks like u have been some hard time... hope your agent is doing their job>> btw why don’t u try some other state for a new visa option?? Have you tried? What’s your current visa! BVA OR BVE?
  7. Yes I won my case within 4hrs without even attending. But it took 14months for AAT to open my file. Then they requested few documents, we submitted them in 15days, on the 15th Day around 1pm. AAT Approved the Nomination straightaway. I am from SA, Retail Manager. following my win, there is another applicant who won his case the same way as mine. Follow that page and read the previous posts. You will see the entire story. btw what’s your occupation and state?
  8. Sorry to hear this... but don’t loose hope. join the AAT APPEAL FOR 187 NOMINATION REFUSAL page. You can take it forward with success AAT stories on that page. i had the same reason for my Nomination Refusal in December 2017.
  9. I Agree on everything... Good Agent who has experience in dealing with AAT will be able to win the cases. Currently in South Australia AAT takes around 12-14months to open the file.. first I got my Nomination Approved by AAT within 4hrs, then another guy on this forum he also had same case as mine, from South Australia, his Nomination also Approved by AAT within 3days. hope everyone’s AAT files will get processed soon
  10. if I apply AAT for nomination refusal my visa file will also get refuse - WHETHER YOU APPLY FOR AAT or NOT, your Visa application will be refused in few weeks time. if yes How long AAT processing time will be - AAT processing time will vary state to state. But roughly around 14-20months for them to open your file. can I wait overseas for AAT decision or I have to keep working for same position until not get decision - NOT a good idea, because in the application, you have already mentioned that you are working, the employer needs you. So if you leave the country, the AAT will also refuse the file, because if the STORE is running without a Retail Manager (your self), then they don’t need this position to be filled. If you are planning to stay here in Oz, AAT is the only option and hope for you. Since you are on BVE, you cannot do much being On-Shore I do understand that you have not seen your family for a while and they have not seen you either, that will be so much pain. But if you leave Oz, you will have to submit a new application for another visa type Hope everything works out well for you. Let’s keep praying...
  11. You mean, you appealed for AAT in JUNE 2017?? Which state and what’s your occupation?
  12. Sorry to hear about your Refusal. Immigration is treating every application as Forge and refusing it without requesting further documents. But if your case is genuine, if your RCB was approved and you have been working for the employer, I would suggest you to go for AAT with a good agent. Because you don’t have much time left to decide or apply for any other visa. After applying for AAT, you can work on your Nomination File with your Current Agent or New Agent. You will easily have minimum of 12 months to prepare your documents for this Nomination or any other visa options. But saying that, if your NOMINATION is Refused, your Visa also will be refused in few weeks. If your visa get refused, you will not be able to apply for another type of Visa ON-shore. You will definitely have to exit the country and wait for a decision. According to my knowledge and experience you have only one option, apply for AAT straightaway, but your employer has to support your 200% throughout the process. let me know if you need any help, I’ll try my best. cheers

Hi Ring3018, Their main subject of the Letter sent to my Agent was PROVIDE MORE INFORMATION, Such As BAS, JOB DESCRIPTION, RCB, SO n SO>> FOR ALL THESE MY AGENT GAVE A HARSH reply saying everything is on Immi File pls refer to that.. but I would like to submit an argument to the AAT Officer and he submitted his own argument stating the mistakes what the previous Case Officer has made and they are unfair, therefore the Nomination Refusal is not a FAIR DECISION.
  15. Hi Cippalippa, No News yet, today (10th May only I submitted S56 - More Information via email. So don’t know how long it’s gonna take for the Case Officer to have a look hope he will look into it very soon early as next week and send me the good news. any news from ur side? another follower on this forum WAI had similar case as mine and he has won the case in the same way. 100000% exactly how it happened to me>>
  16. Congrats Happy for you. you will hear from them in 2 weeks time. If you don’t hear back from Immigration by the 16th of May... shoot them an email saying my Nomination has been approved by AAT. My Visa File will be forwarded back to Your department or you would have already received. Please let me know what would be the process and prep edits from there onwards. soon as you send that email, the idiots will look into your file and send you an email for S56 (requesting more information). Mainly they will ask is AFP HOME COUNTRY POLICE report if you have been there since you applied for 187 MEDICAL (if it’s expired) if you think your Medical was done 2 years ago, I would suggest you to do the Medicals again... coz it’s very difficult to get an appointment in Adelaide BUPA. Currently I am in Victoria, came to do my Medicals. These are the documents they mainly ask, and this is what they asked for me too. Btw who was the AAT officer who approved your nomination?? Is it P******R E**********N??
  17. Hopefully you should hear something good without any delay. The documents what you have given is good. But your agent’s argument against the refusal should be VERY STRONG. If that’s good, then you don’t need to worry anything about your AAT. Btw did you say you applied from SA? Who is the officer or admin has asked for your PROVIDE MORE INFORMATION for AAT.
  18. Hi Cippalippa, Yes you are correct, only my NOMINATION was approved by AAT. According to my agent, AAT will look at only the main file. Which was our company Nomination was Refused. So we argued against that decision and AAT straightaway remitted the decision and send the file back to Immigration to reconsider the Visa approval. AAT cannot approve both, because we argued only for Nomination. If my Nomination was approved earlier and then if I have applied for Visa Appeal, AAT would have approved. Therefore now Immigration Department has requested for further documents, before they approve the Visa. hopefully will get it ASAP.
  19. If your agent is not doing their job, I would suggest you to move to another agent than wasting your time.. that’s what I did in my case... I cost me bit extra>>> but stress relieved...

Let me know, so I can check and let you know if anything else to uploaded. if you are in the EXACT SAME SITUATION, I guarantee you 100% you will get it within a day, without hearing. Because now they know what has happened in SA for Nomination Refusals... wish you all the best..

Hello everyone.. just a quick update.. i have been contacted by IMMI to provide more information * AFP * Health Assessment * ANZCO evidence for my Overseas Qualification * Complete form 1399 PLEAAE NOTE: if you have won the AAT Appeal, pls trouble the Department by emails and calls. Because I just sent an email to Department saying, I have won my AAT for NOMINATION, when are you going to process the VISA file. Within 5mins I received an email from Case Officer, requesting further documents. Good Luck to everyone...
  22. My agent is not from SA. He is from Melbourne, Victoria... i have shared his details in my previous posts (Page 7 or 8). your agent can be anywhere in Australia. Doesn’t have to be from the same state...
  23. I believe the processing time will also depend on the state too. Because VIC n NSW will have plenty of AAT files to look into>> wherelese WA n SA will have less files. According to general processing time, I was expecting my AAT file to open end of this year... but my AAT File was opened in 14months and finalised 4hrs... lol still I cannot believe how it happened
