  1. I think they must assign cases randomly...I have been waiting since December 2017 and the case has not been activated yet .... I realized is not worth stressing about it just have faith and don't give up
  2. man I am not a migration agent unfortunately I cannot give you any advice... just wait till Monday
  3. i am pretty sure that once you appeal you can only wait for the appeal can't lodge any other visa application onshore... so just evaluate your options sometimes re-lodging another application suppported by better documentaion/evidence can be quicker than waiting for AAT decision
  4. I am not too sure you will need to ask your migration agent
  5. you have 21 days to lodge an appeal at AAT speak with your agent
  6. Good news for you, at list you had your hearing. I am still waiting but looks like it takes at list 3 years to get an appointment to the hearing. Did you lodge a combined nomination and visa application? I am just hoping that they might do a combined hearing to speed up the process a bit One last thing did they refund the appeal fees? Cheers
  7. Good to hear about all these new PR... has anyone waiting from AAT decision received any update? I have been waiting since December 2017 but still no new notification from the tribunal
  8. If PR was granted before the bankrupt of the business he/she should be fine.
  9. Hi there, I hope you are all well guys, I have one technical question for you if anyone has a clue. I applied for a 186 TRT visa a while ago and I am sponsoring my partner as secondary applicant /defacto, she was also on the previous 457 visa. We never registeted our relationship to registry of births, deaths and marriage and I am wondering if our relationship will be recognized by NSW law regardless because listed on visa. Thanks in advance
  10. Hi Raul, thanks for your reply Raul. I am aware of that but is it fair? Why advertise on the website that if we require additional information we will contact you? In my case for example we had a really good cooperative collaboration from the immigration during the sponsorship applicatiom back in 2015. By having that my employer and myself were pretty confident that if they needed more documents they would have ask but they did not. I mean they point is, we thought they were working to help us but obviously is not the case, isn't?
  11. Hi guys, I just came across this link: https://archive.homeaffairs.gov.au/about/contact/provide-feedback/compliments-complaints-suggestions/claiming-compensation-from-us Does anyone know if is possible (or ever tried) to claim compensation from the Department of Home Affairs & AAT for Detriment caused by Defective Administration? For example: - extended delays went way over the "forecasted deadlines of AAT calendar" - unfair refusal decisions from the Department without asking supporting evidence
  12. Hi guys, I hope you are all well, I am starting this topic to see who else is in the same situation waiting for a decision from the AAT regarding nomination refusal for a 186 TRT application. I applied for a 186 TRT as "Architectural Draftsperson" in July 2017, the nomination was refused on December 2017 for "Financial Viability" of the business. We lodged a double appeal (nomination and visa) to the AAT and currently still waiting for the case to be assigned. Anyone waiting for the same reason?
  13. is crazy... I think the medical is only valid for 12months after might need to be redone again...i did my medical back in june 2017
  14. Speak with a good immigration agent, I think that if your boyfriend likes his job and does not mind keep working there for the next 2/3 years you can easily win the case at the AAT
  15. Hi Nat, I got refused for the same reason in 2017 and still waiting for a response from the AAT. You could try and lodge another nomination again providing more evidence to support the business situation and justify why the business is in debt at the moment by providing accountant letters, local business letter of support or similar things. Many businesses are in debt but still manage to pay their employees wages is just the way it is in the world now. If you research you can see that even the Department of Home Affairs is in debt, how do they pay their wages? Good luck
  16. Hi guys, I am starting this new topic to try and understand more about the dynamics of the processing time of the appeals with the Administrative Appeal Tribunal (AAT). I am currently waiting for a response since December 2017 after the 186TRT -Nominatiom of my employer was refused. I am up to over 520days of wait when it was originally forecasted to be around 480days, unfortunately the case has still not been assigned and there is no clear indication of when it will happen. It could be tomorrow or next year. I find this a little bit unfair as most recent cases are given priority over older cases like mine which are still stuck in the limbo. If you are waiting for a decision from AAT you know how frustrating can get, if you don't mind chatting about your situation and share your frustration you are more then welcome to join this topic. I reckon the best we can do is all support eachother
  17. Good morning guys, I was doing some research on how to prioritise a case with AAT and the definition of compelling reasons. I found this document from AAT. Does anyone have a clue about which cases will follow under the following? (a) cases where long delays in the review application being constituted and considered would result in the review applicant no longer being eligible for the visa applied for, even if the primary decision were to be set aside. I was originally nominated as Architectural Draftsperson, this position is now on the STSOL list. Do I fall under the above? Thanks
  18. Ok, i went to look at the old email with the invitation to comment nomination refusal and the subject starts with "Team 01- IMMI Invitation etc.. etc... " Any idea what Team 01 is?
  19. Hi Carter, do you know how to find out if the application is/was low risk or not? cheers
  20. Yeah is crazy. I am wondering if we can all team up and make a "mass" request to AAT to prioritise all these cases which are obviously been unfairly treated.
