Nah, with RSMS you can be approved no matter when you're onshore or offshore.

Some specific visa requires you to be onshore to be granted for example 485 visa.

Yes I do understand that but if you apply Onshore you have to be in the country and if you apply offshore you have to be outside Australia, you can't be in the country and have an offshore application.

I think your visa will not be approved until you leave and go offshore. If you are holding the same passport for your application and you are in the county already.

For example if you have a French and Italian passport and you applied offshore on you French passport for your 187 Chef visa and you are in Australia with your Italian passport then your visa can still be granted. But if you have only one passport and you in Australia already but your application is offshore your visa won't be processed until you leave.

This is my understanding, (through a friend who has Italian and Brazilian passports) if anyone finds this explanation wrong please don't get hyper about it, just present your explanation.

    Hey guys,

Do you know how long medical check last for? I took it on December 2018 and im just getting pregnant, so confusing if they ask for x-ray again or not. I already have nomination approved and S56 only require for police check. Should they ask for s56 for couple times? (Only me in the visa application)

    thanks so much,

    Hi Linh,

Immigration can ask for s56 more than once but since you are the only applicant it is very unlikely for them to ask for another s56.

Regarding Medicals - it's always valid for 12 months so till November 2019 your medicals should be fine, however if they do ask you for another medicals and they find that you are pregnant they may delay the processing of your application till the birth of your child.

You may get a good case officer who will accept your medical even after 12 months, there has been one person on this forum who was not asked to do another medicals even after the 12 month period had passed. So fingers crossed hope you get a good case officer. 🤞

did any one email directly to immigration.

    is it a good decision

    mine running on 20th month..

    even file not taken..

    dont know what to do...

    please give an advise

Unfortunately its pointless trying to call them coz your call goes through a call centre that can give you very basic/minimal information... They can't speed up the process of your application. Until a case officer is not assigned its just a waiting game.

This is my experience trying to call up.. May be others have had better luck.

My visa and file open this Tuesday. Asked for documents. PTE result in visa and in nomination asked for employee contract, job description and organisation chart. Submitted everything. Yesterday but i have a problem my  PTE result has expired. I done PTE in January 2016 and lodged visa in March 2018. When I submitted application PTE was valid but now its expired.  I already booked a test next week. I will get my score for sure equal to 6 each but if i faild to get require score what will happen? Is it possible CO will give me more time?
    Please share your experience.
    thanks

They shouldn't be asking you for English scores again... As long as it was valid at the time of applications (which is 3yrs) it should be based on that score. You should tell them that you have already submitted your PTE.

Congrats mate. You were so brave to quit the first job. Enjoy your life in Aussie.

Thanks Carmen... I'm going to quit this job too now... You know how stressful it is being sponsored by these employers who just want to squeeze you dry...just coz they think they are doing you a favour☺️😏

Immigration ask for documents in june, did not get anything after that, agent told me that immigration doing investigation and monitoring business dont know how long it will take 😭

Hopefully you hear some good news soon...in my case no further documents were required just a few different police checks...what's the turnover for your company?

I got a s56 request for my NZ police check while i had submitted the police checks of all countries that i lived more than a year and the Nz one is the most updated(27/3/2019). The other countries are 4/3/2019 and 19/1/2019. So confused whether they ask for them again coz I expected that it could be the last step. Do u know how long a police check and a medical check last for? Did u check and submit your police check and medical check before?

All police clearance and medicals are valid for only 12 months... According to dates if your nomination is approved then there is very little chances of immigration asking you to do them again.

    Hi Mark,

Im so confusing abt s56. Is it only about personal issues such as police check and health conditions? Can i pls ask what did they require u in the both s56?

    Thanks Mark

Linh they asked for my UK police clearance and medicals in the first s56 and the second s56 they asked for my wife's UK police clearance and my German police clearance.

    Hi all,

I have lodged my RCB beginning of Aug, officer requested more info in Sept, and since its been a month I have got no news.

I know most of you have got their RCB approved and are at the visa stage, but has anyone of you been through this? I really thought RCB process was straight forward, but I was indeed wrong.

I wont lie, am really worried cause am left with only 4 weeks to apply for the visa (I am also aware, am wasting time cause I can apply for it now, but my lawyer recommended me to wait and apply it all at once, once this is approved). I am just scared if i lodge now, and this come negatif, what will I do.

I am applying from NT, would anyone know whether they are under the pump cause 187 is coming soon to an end?

    The wait is killing me.

    Thanks folks!

My RCB took nearly 4 months to be approved... Don't wait for the RCB, many people are getting a positive outcome for their visa with a rejection in their RCB. I'm not saying its not important but its no point waiting for that. I applied for my visa first then a month later I applied for the RCB and nomination. Force your lawyer to proceed with your application.

It’s hard time when they ask for docs and not reply ..

Yup and there is no way you can contact the case officer like 10 years back where you could contact the case officer by email... Now its just a generic email address or the call center number where they can't provide you with proper information.

    Hi

I have a bit of tricky question to ask.

What is considered full time work.

38 hours or whatever the contract says.

if contract says 40 hours per week.

Will the extra two hours considered overtime. Or not.

Please someone help me with that.

Department of immigration does not care if its 38 or 40 as long as its not below 38 hours, but according to Fairworks they described full-time as only 38 hours anything over that should be overtime. Unfortunately some employers will find a way to get around that to cheat their employees😁

    Hi all;

RCB got refused but The company had positive RCB 2years ago for the same position.

RCB has validity for 2years only.

Anywys MA wants to apply for nomination with negetive RCB saying there is a strong chance of the negative rcb not affecting the nomination decision (i dnt understand how)

has any one got nomination approved without positive RCB?

    much appreciate your response.

Your MA is right..file your nomination and visa quick...there are many people on this forum who have had successful outcomes with their nomination even though their RCB have come up with a negative outcome. Don't waste time mid November is coming soon 👍

Thank you so much Mark. If you could please draft me something so that i can have a look at it please.

I am a bit stressed to be honest, as this visa comes to an end by end of October and I still havent lodged yet. Btw, I had to start all over again as the first time I got sponsored, my employer had my position redundant, so am just really mentally drained and exhausted with all the stress and worries I am going through at the moment. On top of all money spent Immi has made it so tough for us while we are just trying to do it the right way. I am not giving up yet, but just really tired with all honesty.

That's perfectly fine, we are all here to help one another, I am attaching a word doc. on your private message. You can get a good understanding as I used a similar letter for my job. The other thing is that this visa shuts down in mid November, so as long as you submit your visa application, the rest can follow in due course of time even after November, you will still be fine. I respect all those who are doing it tough and still doing the right thing, its frustrating to see people who are getting in through the back-door doing all dodgy stuff like paying the employers to sponsor them and other heaps of fake stuff and still getting their visas but people who are genuinely applying through the right channels are getting refused. I hope you get your application sorted...all the best!!

    55K... Export Coordinator

Your salary sounds alright for your job and location. The median salary for an export coordinator in 58k but you have to take into consideration that you are in a regional area...so all you need to do is explain this in a formal letter on the company letter head and give a parallel example of the same occupation and salary according to payscale, Glassdoor or seek and that should be acceptable by the department. If you want me to draft a letter for you let me know, I'll send it to you in a private message.

    Hi guys,

I am still at the RCB stage and already having the officer asking questions about salary market.. has anyone been through this? any recommendation on how we could justify my salary?

    Thank you very much.

What's your occupation and salary? Is your salary higher or lower than the current job market? Based on your answer I could suggest a way.

how can i do that ? can your MA see if somebody has checked into the account ?

what would it change if the file is on further assessment? would it mean that a decision is coming soon?

You can do that by creating an immiaccount on the immi website, the information needed will be on your bridging visa in order for you to access your file, it doesn't matter if your MA knows that you have made an account to check your file, after all that's your application and you have the right to view that. If the status changes to further assessment that means your on your final stage, the case officer is verifying all your documents and will be processing it soon, if it still in initial assessment that means - no one has looked at your file yet but it doesn't mean you are stuck, it could all change from initial assessment to finalised directly. Hope this answers your question!! All the best...
