  1. @27May2016 Thank you for sharing your experience! Since I posted that the owner of the business send a termination notice through email June 27th @5am which dropped in the motel mail box when I opened the office informing that I am no longer employed as June 27th @8am, at the same time relief managers were arriving. In my honest opinion it was a very coward way, justifying his actions with a number of inconsistent events and lies, but anyway, i am free of that misery. He is taking 4 weeks of wages and a promised commission from me.

Thanks! Link: Good afternoon dear friends I am having a bit of dilemma and not quite sure how to proceed so I would like to listen some of personal experiences as well as some advice regarding reporting employer to Fair Work and consequences for my situation. A bit of background: I am employed as Motel Manager and had my visa sponsored by the company as RSMS 187 located in the NSW South Coast, it has been granted on the March 7th 2017 while away on my annual leave. I have been working here since October 15th 2015 acting accordingly to the agreed terms to increase revenue, manage and maintain the motel and so on. Worked most weekends and pretty much all holidays and festive periods since that date without receive any penalty rates on the grounds of having only 4 days off per month. So far, so good I quietly delivered my side of the commitment, however, from January 19th 2017 I have not been paid on date sometimes up to 7 weeks delayed including my annual leave which was not only paid vary late and without the load of 17.5%. On top of that the owner is constantly harassing (threatening to report to Immigration, accusing me of "testing his intuition', supposedly received a number of guests complaints about myself and the rooms presentation, that he would give a chance to sign my resignation but not fire me even though he verbally told me that I was fired or that I am no longer employed, and so on) and accusing of wrong doing yet without present any details or proof, with even more frequency these days as my wife is now pregnant and cannot be on site due to a risky pregnancy, for that matter living in Sydney to attend appointments and monitoring her pregnancy. Note that my wife has never been on the formal agreement but usually regional motels hire couples, never received a dime for her work. After being ripped of from the promised commission, increasing revenue by 35% from previous 4 years along side other KPIs this constant harassing is taking a heavy toll on my nerves and after speak to managers that look after businesses nearby I found that he has a fame for pushing people to the edge till they just leave, as a matter of fact, prior to me there was 11 managers in 5 years, being myself the only one staying more than 12 months. My questions are: How to proceed with reporting conditions to Fair Work? What sort of formal notice shall I provide to the employer? Consequences to my current visa situation and future job applications? Has anyone experienced any similar situation? Thank you all in advance Daniel

A little late but worth sharing to help others to maintain their calm through the process. 187 Direct Entry HR, 2 pax Application: RCB 8 March2016 (Approved following day) Visa 14 March 2016 Nomination Approved 1st February 2017 Docs requested: 1st February 2017 (relationship proof, updated Aussie Police check) Visa granted 7 March 217 The whole thing only 1 week short of a year. Had it updated on the spreadsheet as well. To all on the boat, take a deep breath carry on with life and let it go. It consumed me from the 9th month till the end of 2016 when I just decided to let it go. Good luck to all!!!
  5. Definitely check the thread recommended by MaggieMay24 and the spreadsheet but just for reference mine is now 10.5 months and counting.
  6. That is a good point, someone publish similar extract in another thread in this forum. As it does not discern between offshore and onshore applications I would interpret it a two years commitment to the position, those applying onshore it starts to count immediately from day one at work while those offshore would have the clock counting from the moment they are then allowed to migrate to Australia to start their employment. It is quite blur lines really.
  7. @March Funny you have mentioned it, I have requested to take an annual leave for 4 weeks counting from early February and I have an impression that my employer is up to something. He is a bit doubtful and makes a storm from the tinniest things even though the business has improved its annual gross revenue by 30%+ and reduce costs significantly. I just hope to obtain a final answer from the DIBP so I at least have something to carry me on through the next year. It has been agonizing 10 1/2 months now. Wish a great week to you all!!

  9. @October 16 Mate, not to disappoint you but it may take a while, some of us here have been waiting since March 2016, in my case, or even longer, read a few pages back and you will have an idea, keep in your mind up to 10-12 months, if coming earlier great, otherwise it will certainly case a lot of frustration. Always count on the mates on the forum!
  10. Huaer Even though your nomination date back end January what maters to Immi is the date your visa has been applied. I guess you have received a copy of visa lodge receipt from your agent, if not you must request him to forward a copy to you, with all information in hands Google 'immi account' and create an account so you can follow the application without relying solely on your MA. Even if you decide to call immigration they will request you to provide a series of information to double check your identity as the information is confidential. Best thing is to maintain a open and trustful relation with your MA and make sure you are well informed in all stages, in the end of the day you are the major stakeholder in the application. Stay calm and be patient!
  11. I am on the same boat, funnily enough even the same for visa lodging date. Nomination was lodge on March 6th granted on the March 8th. May the force be with us!
