My company name also xyz Pty Ltd and xxx family trust. My MA has not enough information regarding this can you please ask to your MA. But from the same company 457 visa was approved how come she get approval then very confusing.
Thank you.
It seems like your MA do not have enough knowledge regarding this matter, otherwise they have advised you from the start.
I don’t think you should ask this on a forum. Regarding this important problem, you should ask another MA or lawyer before it’s too late.

My friend just got his nomination approved as a Hotel and Motel Manager. Salary is only $49000. I guess because the business is small, the longer the processing time.
RCB, Nomination, Visa 28/06/2017
Nomination approved 20/02/2019

Hi

You must be the one who waits the longest here. Have you ever considered called them yourself instead of your MA? 32 months is too much

Urgent recomendation post again
AAT / apply for new nomi & visa ?
MA is saying for AAT. I am on 485 visa and have time to be ready for new nomi & visa.
really really confused. Please suggest
Both way will cost great deal of money.
If you still have 485 i think you should go for a new nomi visa. It’s safer that way

Are you a social worker? I'm surprised you don't apply through 189 with experiences. My friend just got his 190 social worker with master of social worker and 7 Ielts.

Hi I am a silent reader too and would like to share my case.
I applied for 187 DE/ Accountant-General. Nomination and visa application were both lodged in July 2017. All required documents were completed before lodging thinking processing will take the normal processing during that time (6 mos).
It took DOHA 19 months to open my file. Nomination got approved last week without scrutiny. Business financials were updated every quarter since lodgement.
Visa is currently on initial assessment and DOHA is requesting for updated AFP check and medicals because initial documents got expired.
They are also asking for evidence of registration/license or non-requirement to hold. I have prepared documents and legislation to support my claim for non requirement.
Is there anyone with similar case? I may have missed information for the evidence required and any inputs will be highly appreciated?
Hi, which date of July did you apply for? Just want to update the spreadsheet. And any documents asked? Thanks

Your agent is right, recruitment consultant have caveats: 19,21,23
19. Excludes positions that are in a business that has an annual turnover of less than AUD1M
21.Excludes positions that are in a business that has fewer than five employees
23. Excludes positions that have nominated annual earnings of less than AUD90,000

Sorry, I can't really distinguish the difference between visa and nomination. Is the nomination apply by myself or the employer?
I can just tell you that I paid the visa application fee in Nov 2017...
Did you use an agent? Nomination part is for employer, if your nomination approved then they will check your visa.

The reason for the refusal was it did not met the requirements. We have provided all the necessary documents and have attache all the legal documents which proves the visa conditions. Still i have received the refusal.
My lawyer suggested he will apply the AAT asap and my employer fully supported me. They said that we have not done anything wrong ao we sont need to worry about it. It will fine on the hearing.
But i am extremely stressed out that how long i have to wait for the AAT appeal. As i have alrraady waiting over twenty months so far.
Do you mean it’s not genuine in their opinion? Or the ability to pay for the next 2 years?

Hi Guys,
I really need help and suggestion on my case. I seriously have no idea what to do. I am going through lot of stress because of this visa issue. I have been told by my lawyer that she had most of the positive responses on the visa, and she had never refusal on this sort of cases earlier and the same position got successful in past.
I have applied for rsms in April 2017, under customer service manager position. Position is genuine. Have submitted all the necessary documents as to meet the requirements. Recently our invitation/visa got rejected and my lawyer suggested to apply for AAT appeal straight away.
What will happen next ? And how long i have to wait for the AAT appeal considering the current time frame?
is anyone going through the same situation? Or have had the same situation in past?
can i apply for another visa if i meet the requirements while i wait for AAT appeal ?
Kindly please suggest what should we do?
I look forward to hearing from you soon,
Thank you,
Kaushal
What's the reason for your refusal and timeline?
Depend on the visa but mostly you can't apply for another visa if you don't have any subsequent visa (bridging visa is not a subsequent visa) and you have the history of refusal visa onshore.
If you have an agent or lawyer you should contact them immediately with other plans.

We do not have a list. Based on the information available on this forum the processing of some occupations takes more time. Because for example there is more risk for immi when a person nominated by a small beauty salon as a hairdresser or a small restaurant as cook be a non-genuine applicant compare to a person nominated by large cooperation as a manager. There was a discussion about processing time if you go back a couple of pages you will see your case usually be inactive during 80-90% of the waiting time (just collecting dust in the system J ). I think immi keep those high-risk occupations for a longer period to see if the business still operating or if the applicant still working in the same occupations. I read a couple of posts here about small business closed or sold during the waiting period.
I heard about this all the time.I think that’s a very unethical move from the immigration compared to before (processing time 3-4 months for 186 or 187).
There will be cases like business closure or change of ABN. And if that happens, immi can take all the money although it’s not the applican’t fault. Last year there are a bunch of assumption refused for 187, those who didn’t even have a chance to provide more documents as well.
I hope this year there will be improvements

Hi all, got my golden email yesterday. Here is my timeline. Hope this give some hope and positive wave to all of you.
Just writing my story point by point. so easy to understand for every one.
1. RCB - lodged in march 2017 and approved in April 2017
2. Visa and Nomination applied in may 2017
3. Nomination approved - 5 th October 2017. ( my employer got call some days ago from immigration before approval )
4. file open same day - 5 th October 2017.
5. Further request - AFP ( my and my wife) on same day 5 th Oct 2017. document submitted in one week. (around 14 th Oct 2017)
6.After three weeks, same Co asked for medical check for both applicants.
But between first and second request, we blessed with boy. so, I had to add his name in my file. So I had to applied his birth certificate and passport. it took five weeks. In between I and my wife finished our medical check. in this period CO changed because of X-mas holidays started.
7. New Co asked my son's medical. I submitted on 7 th jan 2019 ( done by GP). But more than 28 days passed from last documents submitted, I did not hear anything from Co . My agent sent two emails to Co in between 28 days time periods. Than agent sent another email on 14 th feb 2019 to CO
8. And finally on next day, 15/02/2019, visa granted for my whole family.
9. Position - cook
10. Perth WA,
11. Resturant turn over 1.3 million.
12. Almost took 21 months.
Best of luck all of you.
Nomination approved in 5 months? So quick

Nomination refused without asking any docs (after 19months)
Reason ::
In business premises lease contract :: its written the place is to be used for storage and distribution of goods
case officer thinks (in brief) that the nominated role task will be more of a supervisory role instead of a sales and marketing manager role as the place is leased under storage & distribution of goods.
Again as the MD is also active in the bzness case officer is not convinced that the role of S&M manager shall be executed properly.
National Company with 30employee - i run a team of 10ppl under 4branches with $10M annual sales
please advice :: do I have any chance if i go for AAT?
Go for AAT, you will surely win. This is such an assumption.
what is your timeline?
187 Visa Processing Time
in Working and Skilled Visas
Posted
On the website it said that even without RCB, the nomination still can be approve with enough evidences. However, given the high refusal and long processing time wait for 187 visa, it's still wiser to have RCB approved before lodging nomination.
