    And student visa bring money to Australia... so why not accepting? it doesent say anywhere that australian government must accept or grant a certain number of PR every months... even if it is frustrating for us, but unfortunately this is what a good government is doing to protect its country... 

    Why not accept is the ethical question, because they know even if they accept student visa, the students can’t come to Australia anyway, that’s like taking their money but knowing they can’t get the products.

    and please, two years ago before this pandemic in the end of 2018, the processing time is already 24 months. Now this visa stops, that means only current applicants got affected. 
    i guess you have got your 187 already, because if you’re not I don’t think you will say this.

    4. Case opened - 31/01/2020 and requested financial and training benchmark documents.

    5. Documents submitted - 14/02/2020.

    5.Got reply on 03/03/2020 and scheduled hearing on 20/03/2020.

    6. Attended hearing and it went 1.5 HRs and they did not tell the decision and she said she will send email following week.

    7. 25/03/2020 - Asked latest training documents.

    8- Submitted on 08/04/2020.

    9.15/04/2020 - Asked about my nominated occupation(Developer Programmer) that how many are there from the company and my project.

    10. Replied on  18/04/2020.

    11. Nomination is approved on 28/04/2020 and sent to immigration... and waiting...

    That is a really long time waiting. May I ask do you still work in the position when AAT opens the file? Congrats

    yes we had to provide all the genuine position + again financial.

    they will ask on the hearing based on documents that you had provide before. 

    Same reason as mine and my husband worked for 3 years, maybe another year until AAT opened ours.

    may i ask if you provide any documents for genuine like a genuine statement or we just need to answer that through hearing? I absolutely have no idea what to provide for genuine.

So they did asked all the position, why, when all the questions that why the company needs him there. Cause financially everything was good and profit. They couldn’t asked about financial’s staff.

    At the end  The member was happy with what they heard and said they would make a decision after.

    guys almost 4 years since nomination started sent documents and now the day has arrived. OMG I can’t believe it right now. 
    Anyway our agent said it still have a risk with migration... they still can ask something specially now with covid19 going on. But we don’t think so.

    we need to send polices, Ielts and skills certificates to migration. And then wait our email. 
    so that’s all happens 🙏🏼🙏🏼

    Hi Leticia may i ask what’s his refusal reason? Do you have to provide any documents about genuine position or they will ask in hearing. My agent asked me about documents of him hiring staffs etc to prove genuine when we were refused because of financial reasons. And how long did your husband work there for? Thank you wo much

Would you answer something different to make more evidences on the case ? My husband’s Hearing in between 2 weeks and we are so freaking out right now. We have been wait for 28 months this hearing and now is gonna come up by telephone which you can’t see their face... making harder to believe. Are you confident ? And please which documents they asked more? Because ours have already asked and hearing is booked. So they can ask more after hearing ?

    Do they ask only financial documents for your side? Did they ask anything else like payslip or bank statement or super statement? Thank you.

    Case officer allocated on 20th December 2019. Requested to update Medicals, AFP and "Evidence of English language ability - verifiable evidence of PTE test results".

    And evidence to support inclusion of our baby in nomination as our baby born after our visa rejected. And we were not able add baby into the visa application or to AAT as department cannot add new applicants when the file is under review. Same with AAT, they don't add new applicants to the process. (So we provided a letter from employer on company letterhead saying that the new born to add to the nomination). Immigration has given a stand alone bridging visa for our baby with no travel rights. So when it is under review, baby cannot travel overseas, if baby travel overseas baby's bridging visa will be cancelled and she needs to lodge visiting visa to re-enter Australia (which will be very hard to get visiting visa for a baby as immigration and my MA both mentioned).

      I have submitted medicals, AFP & PTE with visa lodgement in 2016 and ofcourse all of them were expired as it is more than 3 yrs. My lawyer said no need to take PTE test again just call PTE support team and ask them to share scores with immigration. But unfortunately they couldn't help as they don't have any data of my scores because it's more than 3yrs.

    I was happy to take test again but my Migration Agent said "No need to take test again as member only asked verifiable evidence of scores" which was submitted with visa lodgement, not active results. He also mentioned that if immigration take this long to process the application it's their mistake not our mistake. So, I had to write an email to them to get that same information in writing. And MA clearly mentioned and explained all the details why we are not able to provide verifiable evidence for PTE and requested clarification for that PTE scores request.

    I have submitted all documents on 13th January 2020.

    Visa approved on 28th January 2020 for all three applicants without asking any other documents.

    wow, yours are super quick, I applied April 2019, heard nothing.

    Did you apply 187 as well and what's the reason for refusal please?

    My ex-employer is away for holidays & won't even answer my calls. I applied for RSMS 187 Visa 25 months ago with a different sponsor for which I am still awaiting response. Status is showing "further assessment" as per Immi account. My MA has asked for an update for the 187 visa application. I have given an option to request for time extension by AAT before 28th of this month. I am waiting to hear back from current case officer otherwise will have to request AAT for more time. 

    I'm so confused. But the other post you said that your nomination is approved but your application is on AAT?

    Yes I do understand that but if you apply Onshore you have to be in the country and if you apply offshore you have to be outside Australia, you can't be in the country and have an offshore application. 

     

    Yup What you said is right. But you can fly to your country, apply offshore, come back (if you have a valid visa) and wait for your visa that you apply to be granted onshore. 

    Unless you don't have any valid visa at all to come back to Australia at all then you have to be offshore to wait for your visa.
