  3. I'm sorry I forgot to mention I'm from India. So no welfare is provided. Yes. I can get valid proofs as old as all these 8 years, after my dad, that I've been taking care of them.

  5. Hi I am starting a new thread to see if someone could help me understand my situation regarding dependents. I have lodged my 190 visa this month and am looking for some advice on various visa outcomes. I am the primary applicant and have included my wife. Since, I've lost my father 8 years ago, my mother, brother and sister are solely dependent on me for everything. My brother has recently managed to secure a job and hence I have not included him on my application. I have included my mother who is a home-maker and my sister (19 years) who is currently studying. I have got all the medicals and character evidence positive and ready for all of us. What could be the outcome if DIBP is not satisfied with the mother/sister dependency part of my application ?
  6. I searched and realized there was no thread for the April 2014, 190 gang and started one. Please post your waiting timelines and approvals, if any. I see that there is a lot of delay involved currently in the 190 line.

  8. True. But the final decision is by DIAC. Right? So, my understanding is if they agree with me when I say X is dependent on me, they ought to give the visa. If they don't agree, I thought they would give the primary applicant a chance to move forward with at least his PR after withdrawing the dependent. And I have seen more of such cases where they let the primary applicant go through if they don't believe the relative to be dependent (not talking about Medicals or Character failing). Did I just confuse you ? :wacko: I thought she said 'if your brother fails medical OR if they deem him not dependent, then one fail, all fail applies'.
  9. Bear with me, I'm reviving on old thread. @lebourvellec: Can you explain more about the above statement ? I thought the "one fail, all fail' holds true only if the dependents fail in either Medicals and Character. But in case DIAC: * admits they are dependent, they SHOULD allow them to migrate if they are found to be eligible. Right? * says they are not dependent, they should allow us to withdraw the dependent and YET process the remaining applicants. So, what kind of a scenario are you talking about that they can reject the primary applicant other than failed Medicals and Character ? :confused:

  11. Ahh Yes. I get it. Can you help me with the form# I should be filling up after I get the results to upload on to the site ? Btw, I was able to save the application by including the IELTS test date without mentioning the result.
  12. Err.. Actually No. Now this could sound naive. That's because I was wondering if it means that you should GET the result before lodging the visa because, if you know, for the primary applicant it is a prerequisite that they clear the IELTS before lodging the visa. I didn't want to make a mistake at this point and lose money for 1+3 dependents.

She wrote her IELTS exam on the 15th of March 2014, last month and due to some technical issues they have postponed the results to the 18th of April 2014. * Can I now lodge the visa by paying the fees and update the CO that she has functional English via form1022 ? * Can you please explain this excerpt from the immi.gov.au website? Does it mean that the test date should be within 12 months or the results ? It says: To prove that you have functional English you must provide evidence of one of the following: an International English Language Testing System (IELTS) test result with an average band score of at least 4.5 for the four test components (speaking, reading, listening and writing). Your test must have been completed within 12 months of visa application lodgement or can be completed during visa application processing.

  15. @Tappers2oz: Yes. I wish if it were like that. But here in India, it isn't like that. A minor has to be accompanied by his parents with their passports and since now they are separated, it is more complex. But of all, his father is not agreeing to let my wife apply for his passport since he has the kid's legal custody.
  16. @Rupert: I understand that we can get an affidavit from his father (who owns his legal custody) mentioning that he is not allowing for his passport/medicals. I have made a rough draft here that will be made into an affidavit. Can someone correct or add something I am missing here, just in case? I XXXX (biological father's name) solemnly declare and affirm as follows: 1. That I am the father of YYYY (Name of minor child) who is a minor child and is under my legal custody. 2. That currently I am the only one who is taking care of YYYY. He is exclusively in my physical custody and as such I cannot allow him to either obtain a passport or go through any medical tests unless required for myself. 3. I also affirm that I cannot allow him to migrate with his mother, whatsoever, who doesn't have any legal custody rights as per our divorce decree.
  17. Err.. No.. I'm just confused. Applying for his passport is out of question. Can I get the medicals done without his passport?
  18. And to apply for the kids passport both the parents should be present since he is a minor.
  19. He definitely isn't bothered about the payment. He's okay getting him go through his medicals, just that he won't be able to appear for applying his passport. Yes, he is willing to write it on a paper and sign it if needed that he is unwilling to apply for a passport. But it doesn't make any sense to get passports for even non migrating dependents. Isn't it? Not everyone would be having one or willing to apply for one just for the main applicants sake.
  20. I am facing a weird issue here. My wife's ex-husband has legal custody of their minor son (6 years) and she has only visitation rights. * Should I still put him as a non-migrating dependent ? * The kid doesn't have a passport and his father doesn't want to apply for one now. Without his passport, I can't generate a HAP ID for his medicals. What are my other options ? * Do we need to get his medicals done ?
