DeeTowers Posted March 8, 2012 Share Posted March 8, 2012 Hi Guys, When can you apply for PR if you are on a 457??? I am getting conflicting info between websites and people i speak to. The immi website says we have to be living in Oz for 2 years and working for a year withi that 2 years.... Is that correct? We have been here 9months so far and are facing going home due to my husband being made redundant in Sept! he has 7 months to find another job and transfer the visa or if we can go permanent which is both our choice! He is in finance Credit Manager mainly, more recently a project specialist within finance for a mobile network thats how they got his 457. He is a member of the Institue of Credit Management. LKC Posted March 8, 2012 Share Posted March 8, 2012 I think that you are probably best to contact a migration agent. The usual way to proceed with PR from a 457 is to either apply independently for a 175 or 176, or to be sponsored for PR by the employer on an 856. Obviously these options are not going to be available to you, because your husbands job is no longer on the SOL and the employer has to guarantee employment I think for the 856. Your best bet, I would think, is to start looking for another employer. Although this may be difficult, I think it would be the only option, but if and when you do find one, if your husband was to have a skills assessment, I believe that he could apply for an 856 immediately which, as a permanent visa, would obviously be preferable. Then you will know what your various pathways are. You do not have to use the Agent to apply for a visa you could still do the DIY route but professional help would put you on the correct course of action.
