How long do I wait???

Hello there!

Just registered on this site to try and get some decent info as the official websites are doing my head in with all of their changes lately!:arghh:

My husband is a fitter and we applied for a subclass 175 visa (i think!) in July 2009 when a 'fitter' was on the MODL.

We were advised by our migration agents ASA that this process would take 12-18 months.

last year 'fitter' was taken off the list and we were informed that because we lodged our app before they changed the list it would still be processed but could take 1 possibly 2 more years. Its coming up to 2 years in July and I really am getting fed up as my husband is now 43 and we are getting nervous as to whether it will come through in time or we were thinking could we try to go down the sponsored visa route as time is ticking!! :unsure:

Any advice would be greatly appreciated from anyone who has been through this or just anyone that knows anything about the timescales.

I have just looked at the lists and seen gasfitter, fitter and turner and metal fitter. Which one is your husband?

 

There used to be a single list, but now there are two schedules of the SOL which would be relevant ot you, schedule 3 and schedule 4. Of the ones I mention only gasfitter is on schedule 3, the others are on schedule 4.

 

If the occupation is one of the ones on schedule 4 then it would be worth looking to see if any states are offering sponsorship for the occupation. It is very difficult to elaborate more on what your agent has told you, because at the moment these applications are just not moving.

He is classed as just a Fitter and I have seen his occupation on one of the schedules as you mentioned but they are so confusing I dont really understand what these mean!

I think we might see what happens this year and then maybe look to go down the sponsorship route, if we can!

There was some recoding last year too. He might hae been a fitter at the time you applied, but you need to see which occupation that is now mapped to because fitter is no longer there. Once you know that you can look into state sponsorship route. Could you ask him what it is he fits if you do not know?

When we applied he was coded on the ASCO as a Fitter 4112-11, after further investigation (as I was getting very confused!) he is now coded on the ANZSCO as Fitter (general) 323211.

Basically he can make & fit metal parts into machines, he currently works on printing presses.

It looks like we are a priority 4 and applications are to be dealt with in date order so god knows how long we will have left to wait!!

Priority 4 is deal with in date order and only once all Priority 2 & 3 applicants have visas. Hopefully DIAC will change that as currently there are always new priority 2 and 3 applicants jumping in front of priority 4 applicants.

 

I recon you are priority 4. Unles you are on Schedule 3 which would take you to priority 3.

As a pre-July2010 175 applicant you could try like many have to get state sponsorship and this would convert your application to a 176 and priority 2 (they are currently processing April 2011 applicants at the moment).

 

You need to be listed on one of the states occupation lists - and need to be happy to commit to 2 years living and working in that state.

I'm not sure all the links work if not you just need to find the lists via google or something.

 

There are changes coming July 2011 re the points - no idea how that will affect priority 4 or the 176 visas if at all. Hopefully not they seem to have got the SS better under control now with quotas so hopefully they will remain a good option.

 

There was a time when all the occupations were recoded and some people were able to switch the occupation title a bit (but I am way outside my area of knowledge here and may be completely wrong about being able to change) only mention this in case your occupation is not on the states list it might be worth investigating further? But otherwise I think changing your occupation requires a complete new visa application - which again may be worth considering if there is no other option to bring you out of priority 4 and you can afford it if it brings you to the top of the pile again?
