Hello, I'm wondering if anyone can shed any light on my query?

 

My OH and I are currently stuck in migration limbo with the freeze on applications ... We were hours away from lodgement but didn't make it due to external circumstances (devestated!). Teaching Australia / Vetassess / IELTS all passed.

 

We are applying for a 175 with my OH as lead applicant being a Secondary School English Teacher. We were using my skills to boost the extra 5 points but my occupation has now been removed from the SOL. My OH has sat a general IELTS and got band 9 across the board which would have also given us extra points under the old rule.

 

We are now waiting and praying for the new points table to be released to see wether she would be given any extra points under the new system as it is more targeted or wether we would have to wait untill September 2011 when she will have been teaching for 3 years to claim extra points for her occupation?

 

Does anyone have any idea when the new points table will be released? Surely it must be before the freeze on applications ceases on 1st July right? If not, how would anybody be able to lodge applications?

 

A little extra info:

We are applying for a 175 because we don't have the necessary $30,000 in equity or funds to prove to the OZ govt. for the purposes of our application.

 

We are deliberating between Melbourne and Brisbane to settle but will probably initially be living in Melb. As we have family (on 457 visas) and friends there.

that there will be no new points test till the end of the year if at all.

We got caught in all the rule changes last year, so you really have my sympathy. We were about to lodge when the MODL and its associated points were scrapped. As a consequence we had to go for Queensland State Sponsorship and also had to demonstrate the funds.

 

I don't think anyone acutally has that kind of cash sat in the bank. We ended up borrowing it from a generous friend, but I was working on a plan B that involved maxing out all our credit cards and my overdraft, and borrowing a small amount from my sister so that I could put all that money in a different bank account for long enough to get the bank statement. I was even contemplating requesting the bank statements just after pay day for that added bit!! It would have cost us a bit in interest and was going to be very fiddly but if needs must!

 

Our sponsorship was approved in a matter of weeks so they definately weren't bothered about seeing 2 statements. It's a route worth considering though.

Hi Nicky, thanks for your message.

 

Unfortunately we could not go for the 176 option because the state of Victoria require their Secondary School teachers to have specialism's in Mathematics or Technology. Unfortunately my OH is an English teacher so she does not.

 

Queensland do not have (or at least didn't the last time I checked, I will have a look shortly) Secondary School Teachers on their demand list and our very last resort would be WA at a push but they are only in demand in regional areas ... but to be honest, Perth in itself is a bit too regional and out of the way for us so anything further afield would probaly cause us a bit of anxiety.

 

We also worry about the state of the economy and job prospects at the moment. We fear that we may find it difficult to find work in her occupation and fear that if she ended up having to take a different job this may impact on our visa.

 

Unfortunatley all of the above makes the matter of the non existant $30,000 insignificant in comparrison lol!

 

Looks like we will have to sit tight untill september 2011 when she will have been teaching for 3 years to claim the extra points and pray that no more changes happen in the meantime. but with these constantly moving goalposts it may seem more apropriate to start looking at retirement visas! They make waterproof zimmer frames right? :eek:

Well, I believe you don't need to fear. They don't mention anywhere that you should work at the certain position. You just have to work at any job.

Here is the quote:

This is a 'provisional' visa. After you have lived in a Specified Regional Area in Australia for at least two (2) years, and worked full time for periods totalling at least one (1) year, you can apply for permanent residence.

A lot more important to have fulltime job.

Some states are most rigorous with this than others. Some accept a mortgage statement. Others - eg Queensland - want to see a bank statement. The money doesn't have to stay there, but they do insist - even if you've got lots of equity.

Hi Nicky,

 

How much do you think a couple needs with no children and no mortgage? I suppose on bright side we could get money of my partner's family to just sit in bank to show on statement. Also once a 176 has been granted do you know how long you have to enter the country, I asking this on a saving up money timeline.

You have to validate your visa within 1 year of the date of your medicals.... so often this means about 10 months after getting your visa. But you don't have to actually move then you just have to visit. Last time I looked at the rules your PR visa lasts for 5 years and to get it renewed at the end of that 5 year period you need to have lived in Australia for 2 years. And I think you need to have been there for 4 years to apply for Citizenship...

That's our situation... I can't remember the exact figures in $ [possibly $28k but someone will correct me...] but we put £17k in an account for a few weeks and that was enough. Your partner's family sound like just the people to help!

Ok so do you get the medicals before the visa is granted I take it? is it quick for the visa to be granted once medicals are done? I would have thought it would have been 1 year after the visa has being granted. I would want to stay for the rest of my life(if all goes well!!) so thats not a problem with the 4 years for citizenship. What happens with people who only do 2 years......do they just have their 5 year visa renewed?

Hopefully, and I think we could have that amount saved up anyway by the time we go as we aren't starting the process for another couple weeks with skills assessment etc... so hopefully can lodge visa by August time. I'm not to sure on timelines at moment but I'm guessing it still at least 2 years? Who knows with new sol, if they cease existing applications then it might make it quicker or it might be just alot slower with amount in the system at the moment. I wouldn't mind it being a couple years anyway so I can save up and finish my college course. Plus might do a bit of travelling before we enter :idea:

Once you get a case officer looking at your visa application they will ask you to get medicals and a police check done.... the 1 year to enter Australia starts from the date of the earliest of these.

 

I believe if you have resided in Australia for 2 years at the end of your PR visa then you will simply get a new 5 year PR visa after which you should be able to apply for Citizenship if you want it or just keep on renewing as a PR.

 

Good luck - sounds like you have a good plan... just wish we had started much earlier as we are nearly 40 with 3 kids.... though with a lot of travelling behind us.... I would definitely recommend it...

A little different. After your 5 year stamp expires, you still have the PR. You don't need any visa to be in Au. PR is eternal :)

 

BUT if you want to travel out and in to AU, you need to get a RRV after that (Resident Return Visa). It is given to you based on your ties with Australia. As long as you live most of your time in Au, it shouldn't be a problem getting it. If you lived most of your time out of Australia, you may not get the RRV and have to wait in Au until you'll be eligible for it.

 

If after your 5 years are finished and you're out of contry, you will have to apply for RRV and provide evidences of your close ties to Au.
