Urgently and desperately advises are needed!!!

What's the fast track to get a permanent residency?

I start under Sport visa 421 or "regular" 457 and then once having one of those, applying for RSMS onshore. SO is this the fast track?

I am a tennis instructor and a full-time coaching job offer in a regional area, pretty far away from Perth, WA. According to this website, it may only takes as little as 2 months to finalize the process of RSMS. I was going to come back under ETA and apply for RSMS 857 on-shore, but realizing that ETA doesn't satisfy qualified visas for RSMS applications. What if going off-shore, Singapore either once the visa is granted or 1.5-2 months after the nomination and visa application are lodged??? Too much risk?

"This is because your application may be refused if you are in the "wrong place’ "when a decision is made. For most visas applied for in Australia:

• you must be in Australia; and

• you must be in Australia when a decision is made.

For most visas applied for overseas:

• you must be outside Australia when a decision is made.

In addition, if you have applied in Australia you must ensure before you leave Australia that you have a visa to return. Otherwise you may not be able to return to Australia and, if your application is refused, you may not have a right of review." (Booklet 5)

I am aware that my occupation doesn't score amy 50 or 60 points at all, although it is listed.

I dont think it is on the demanded job list of WA either. But I have got an agreement from Tennis WA, (Tennis Australia) that they will write a supporting letter to the immigration. If that's the case, should I consider State Sponsored options? There are no employer AND states sponsored options, eh? Once again, obtaining a permanent residency is the most important thing, but thing is the tennis season will start in 2 weeks and I might have to start under Sport visa 421 or "regualr" 457 (in sport industry, contract is in common, but employment). And then once having one of those, applying for RSMS onshore. SO is this the fast track? OR what if I may be able to be delayed and commence work in 2 months? it would be the best and cheapest option to apply for off-shore 119 RSMS ($1,700. 421 and 457 costs $700 inc. nomination and sponsorship. On-shore 857RSMS $2,500)?

Looking around this website to find answers whole night and it's 10am here. I will be away to take nap and come back later. Please dont hesitate to get back to me maclovesmac@gmail.com too

Thanks guys. ciao, Mac

Hello Mac

Welcome to Poms in Oz.

A State sponsored skilled independent visa is not an option because your occupation is not on the SOL. It is only on the ENSOL.

Tennis Coach 3993-21 - Australian Skills Recognition Information

So you will need an employer sponsored visa whatever happens.

Turning to the rest, your post is quite muddled so let us deal with it step by step:

DIAC are not interested in when the tennis season begins, I assure you! Next season will do just as well from their point of view, so please slow down!

The only way to do any of this fast is if a really top notch, efficient migration agent gives all of you a hand with it. Is a migration agent involved?

The Regional 475 visa was effectively scrapped on 14th September 2009 by the introductiion of the new market salary rates notion:

Whats New - Employer Sponsored Workers& Immigration

Which is causing maximum headaches because DIAC have no clear, reliable, transparent machinery for figuring out what the market pay rate is for a given occupation in a given place.

The only way to deal with a subclass 421 application quickly would be to use a super experienced, super efficient migration agent in Canberra because nothing can be done on-line with a 421 visa and the only processing centre for them is in Canberra:

Specialist Temporary Entry Processing Centre

I suspect that a subclass 421 visa would be more trouble than it is worth if a standard 457 visa would be possible instead:

Temporary Business (Long Stay) - Standard Business Sponsorship (Subclass 457)

The logical progression from a 457 in this instance would probably be an RSMS 857 visa. The whole thing can be dealt with whilst you are onshore in Oz so do not worry about that.

The next thing is to consider the health requirements for temporary & permanent residency respectively:

dima_health - Australian High Commission

If you are going to go to Oz on a temporary visa, you might not need to do anything about Health at this stage but tread cautiously about this. I think TB is airborne and the Aussies are neurotic about it. They are particularly neurotic about it if you are likely to be working in any sort of classroom - give that word the widest possible interpretation to be on the safe side! A couple of rickety posts and a rickety roof can be a "classroom" in Oz even though there are no walls. They do not trust TB germs one inch!If a temporary visa is decided upon, read Form 1163i with suspicion.

A friend of mine is a teacher and she also needs a 457 visa in a hurry. As far as I am concerned, Form 1163i no longer requires a British visa on a temp visa to do anything. However Les Mighalls is a dentist and a migration agent. He reckoned that it would be a good precaution to get a chest x-ray done. They can only be done by approved clinics so please read the list.

The other consideration is that it sounds as if the plan is to get you an RSMS visa as fast as humanly possible. For that you would need full visa meds. They can be done in Oz but only by Health Services Australia:

HSA Group - Online Bookings

In WA that would mean a trip to Perth (or Darwin is that is closer.)

Health For Industry

The meds are valid for 12 months so it may be quicker just to get full Per Res visa meds done in the UK.

Whilst on the subject of meds, if a 457 visa is chosen to begin with, there is now a mega-headache about medical insurance for them:

George Lombard, who started the thread above, would be a very good agent to consult:

Profile | George Lombard Consultancy Pty. Ltd.

George is knowledgeable, efficient, sure-footed and effective, plus he was born & raised in Canberra so he has mates there, some of them in DIAC HQ which might help.

Good luck

Cheers

Gill
