Guest The Pom Queen
Hi @williamc adlam welcome to the forum. I suppose the first thing is are you an Australian Citizen? If you are that’s one box ticked. Now the rules have changed a lot since you have been here. In 2006 they made it that anyone with a disability who was (in the governments eyes) fit to work, for 15 hours a week or more, would no longer be eligible. Now what gets me with this is, I know of a few people who have lost their limbs, are in a wheelchair, but still told they are fit to work and are not eligible. Yet people with a back problem (I’m not playing down back problems but just comparing the two cases) and who were registered prior to 2006 can still claim. Have a read here http://guides.dss.gov.au/guide-social-security-law/1/2/5/10 It doesn’t even stop there, if they deem you can work 15 hours or more in any job, ANYWHERE, yes that’s right ANYWHERE in Australia, then they will not pay it, instead you have to go on to Newstart. There was an article last week in the news about Centrelink stopping someone’s payments whilst they laid dying in hospital. I can’t find that article but here are some similar. https://www.dailymercury.com.au/news/a-brain-tumour-but-centrelink-says-he-can-still-wo/3130867/ https://www.smh.com.au/healthcare/terminally-ill-cancer-patient-rhys-pagaldays-centrelink-support-cut-off-when-he-failed-to-go-job-hunting-20170323-gv4j7p.html Now there are some who have refused to accept this decision and appealed. https://www.couriermail.com.au/news/queensland/amputee-doug-stubbs-wins-case-against-federal-government-for-his-right-to-disability-pension/news-story/15b6505d1ebfe4dccae37f94a2700a7d https://www.theage.com.au/national/victoria/centrelink-asks-paralysed-man-to-prove-he-deserved-pension-20161022-gs88ax.html This is a great resource for the appeals process and gives you an idea what they are looking for. https://independentadvocacy.org.au/upload/files/Disability Support Pension Appeal Fact Sheet.pdf This article is 2 years out of date but also worth a read https://independentaustralia.net/politics/politics-display/the-cruel-pension-eligibility-tricks-facing-australias-disabled,8994 I am really sorry to put a downer on things for you, it’s hard enough having a disability and struggling day to day without having to fight the system. With the new roll out of NDIS I have seen so many participants become suicidal or give up with their claim because they can’t do it anymore. Even the LAC’s give conflicting advice along with the NDIA. In one phone call you get told one thing and then on another you get told the opposite. Im actually looking for work, I can’t go through all the Centrelink paperwork and stress, I just can’t do it. My problem is who will hire me, I am in a wheelchair, I may need to be in the bathroom for an hour at a time, work 2 weeks then have 2 weeks in hospital. ‘People say they don’t discriminate but they do. Now i I don’t know what your disability is but Adelaide have started to roll out the NDIS, they don’t give you money for not working etc but they will (if eligible) provide funding for Assistive Technology (wheelchairs, feeding utensils, shower chairs etc), Daily Activities (personal carer, domestic care, etc), Consumables (if you have PEJ tubes, catheters, syringes, needles, etc), Home Modifications (adapting your home to your situation) then there are two more and I forget the names but one is for Physio, etc and the other is for Social outings. The NDIS process is very very stressful, I know people who have been knocked back and then the same day another person approved and they both had the exact same medical diagnosis. Basically it’s whoever is on the other end, they aren’t medically trained and if they tick the wrong box or miss a box they can change the total outcome. I know of a gentleman who got refused his bathroom Modifications, his support team asked for the reasons why, he had passed 99% of the assessment but was rejected because they had quoted in for new tower rail and toilet roll holder and NDIA said they could reuse the old one. The guy said if they had called him and said would you mind paying for this he would have said yes.

Guest The Pom Queen
Sorry for the delay in replying @williamc adlam I had an operation on Friday so still sleepy. Here is another article today which also states that 70% of disability applications are being refused http://mobile.abc.net.au/news/2018-08-04/huntingtons-disease-ndis-disability-pension-case/10071342?pfmredir=sm&sf194900959=1&smid=Page: ABC News-Facebook_Organic&WT.tsrc=Facebook_Organic As you are an Australian Citizen as far as I know you should be able to claim some kind of benefit immediately. I would say they will probably put you on Newstart Allowance which will mean you have to apply for jobs on a regular basis. Obviously the amount can vary but I’d say you would look at around $1088 a month from Newstart and you should be able to claim rent assist of $272.40 if of course they deem you eligible. Can I ask what makes you want to return to Australia? If you are already getting good support in the UK and benefits then it really may be worth reconsidering.
