489 visa areas?

Hi,

 

We applied for a 489 visa with sponsorship from qld that's been granted, but the visa grant states we can live and work anywhere in australia except

 

Sydney, Newcastle, Wollongong and central coast in NSW

Brisbane and gold coast

Perth and surrounding areas

Melbourne

Capital territory

 

I was under the impression we had to move to queensland, is this not the case?

If you were nominated by a state or territory for your current skilled visa, you must live and work in a regional or low-population growth metropolitan area in the same state or territory that nominated you for your current visa - this is how it is written on the home affairs website.

Although your visa ‘may’ allow you to live anywhere that is classed as regional you have got to ask.. will this affect my application when the time comes to switch to a PR visa as I did not live up to my moral obligation.

It may or may not.... I don’t know

If the applicant who satisfied the primary criteria for the grant of the visa was nominated by a State or Territory government agency, condition 8539 must be imposed.

 

Do not rely on the opinions of case officers or DHA publications about what constitutes a  designated area (or anything else) go the legislation and rely on the published postal codes.
