No audit, just waiting...I've called a couple times and they just say it's in processing...they won't give a timeframe and say it's well within the 5-8 months but it will be 7 months on the 30th...why me :( My agent has also emailed to follow up

thought I would update you on my epic fail of a 186 visa!

So today I had to withdraw my nomination and application due to not fulfilling the 2 years required- this was an honest mistake as I was not aware my previous visa didnt count and I applied a little early so I wasnt overstaying.

So I have been informed I should have applied for an extension on my 457 to allow the 2 years to be completely finished seperate of my 417. I have no filed my case with an MA. My biggest problem is 28 days from today I will go on to bridging visa C- this has no work rights. This is going to have to be argued due to my profession in rural area. It has been a hugely costly error, in terms of both time and error. My MA assures me this happens more than we would like to know! SO luckily I withdrew before it was refused. So here goes the waiting game all over again!!!!!

I'm so sorry to hear that you had to withdraw your application! Best of luck with your new application and I hope it goes through smoothly the next time around.

I know all too well what this feels like mate. I applied direct entry scheme but applied for an exemption for skills assessment. One of the conditions were that you had to have worked for your employer for a period of 2 years excluding any unpaid leave. I applied 2 weeks too early and realised within 10 mins of submitting the application so withdrew immediately but they wouldnt refund me the application fee.

I resubmitted my application and am still waiting to hear back but am now really nervous as I didnt use a MA so I pray that I calculated the unpaid leave right and that I have met the 2 year mark now. Its a sickening feeling though but at least you realised before refused. I am suprised they didnt refuse you straight away - seems strange they asked for additional docs and began processing?

This is what totally threw me off, it has been in processing almost 7 months and never picked up! the additional document thing is what made me hold off withdrawing, so despite going the transition scheme I still had a full skills assessment so would have actually qualified for the direct entry stream after all! It has been a heart breaking nightmare, I have wasted so much money and time. That is such a shame you couldn't get a refund, I am going to apply for one and just keep my fingers crossed. My Ma informed my today that your bridging visa counts towards the 2 years too so hopefully you will be fine !

I am petrified of not having work rights!

Hey TLPJK, again, I'm sorry for what you have to go through. I'm curious to know what were the additional documents they've requested for? I would assume it would be pretty straight forward if you haven't met the eligibility. Having said that, were you advised by your MA to withdraw your application?

Back in May I was asked for a new copy of my UK police clearance and my employer was asked for evidence of the training benchmarks, I was advised my 2xMA and an immigration lawyer to withdraw....

I emailed in July asking for a progress update in which they replied saying it was being processed. Given the advice I received I didnt want to take the risk of waiting and it being refused!

It's a real shame but good call. I would have done the same too.

Hi TLPJK - could you not just re-apply now under the Direct Entry stream rather than applying for an extension to your 457?
