461 Visa, What Proof Required for family member??

Hi All,

 

Am new to this forum, but hoping someone out there can assist?

 

I'm a NZ citizen and have recently come back to the UK with my wife to look after my sister in law, following her recent divorce. She's talked of moving to Oz for a while and I understand that the 461 visa will allow me to effectively sponsor her (& her children) to move to Oz as when I enter I will be special category holder.

 

Question is, what proof/evidence do I need to prove my financial support for my sister in law. I understand that if I were sponsoring a partner on a special category visa I'd need to show evidence of relationship, joint bills bank statements etc, but I can't see any mention on the australian immi website of what I would need to give as proof if it's a dependent family member - not a partner.

 

She (and her kids) are currently living with me & my wife & are looking to make the move later this year.

 

All help much appreciated......

It is a non starter I am afraid. There will be no way for you to sponsor your SIL.

You must be related to the Special Category visa holder as one of the following:

 

 

  • their partner

  • their (or their partner's) dependent child

  • the dependent child of their (or their partner's) dependent child

  • their (or their partner's) relative who meets all of the following:

    • is widowed, divorced, separated or has never married or entered a de facto relationship

    • is usually resident in the Special Category visa holder's household

    • is dependent on the Special Category visa holder.

     

     

 

 

The section I've underlined seems to say that either me, or my partners i.e my wife's relative (her sister) is valid?

The fact that she lives in the UK and can get as benefits, housing, council tax, incapacity if cant work, child benefit, tax credits etc etc, you can never claim that she is dependent on you.

 

 

If she wants to move to Australia she will need to be eligible for her own visa for her and her dependents. Which throws up even more issues as she would need permission from the father to remove them from the country.
