Hi all, need some inputs on this please🙏. I work as a chef. My current employer who sponsored my visa482, still haven't reopened any of their venues. Now i am looking for a new restaurant to work for. Question is - lets say I got a new employer,  instead of transferring my work visa 482, i will ask them to sponsor me 186DE, is this possible? Is it possible for my new employer to sponsor me 186 Direct Entry straight away? or do i have to work for them for some time? (lets say they agreed to sponsor me 186)

Thanks guys. Been down lately, as i keep on thinking about our PR amid the pandemic 😔

Good luck to everyone and stay safe.

Yes, the new employer can sponsor directly 186 DE. I was in more or less similar situation but on a different skill set.

  3. My 186 nomination with the previous employer was rejected in 2017 as they didn't submit some required documentation and there was no visa application submitted from my end, as i wasn't sure if they would really sponsor me. Hence i said to them to let me know once the nomination is approved so that I can launch 186 visa application with the TRN. During this period i was on 457 visa working for them.

Coming to present- I am working for a new company from the last two years on 482 visa and they are sponsoring my 186 DE. Will the previous employer's nomination refusal has any impact on the current 186 nomination application and subsequent 186 visa application?

  5. Hello All,

I am currently on 482 visa. I shall be going through an agent for my ENS-186(Direct or TS).

Is it possible to go for medicals before actually applying the visa? (https://immi.homeaffairs.gov.au/visas/getting-a-visa/visa-listing/employer-nomination-scheme-186/direct-entry-stream#HowTo) says 'Yes'. But, do i need to create my own immi account to undergo health examination?

As i will be going through an agent, will they create an Immi account on behalf of me ? The reason why i would like to do medicals before applying is due to a medical condition of my daughter aged 3.5 yrs, she has speech and few devlopmental delays. But few therapists have opined that my daughter would be able to complete the medicals as their children too went through that phase and unless the child clearly displays severe characterstics of devlopmental delay. but i know it's case by case. If my health examination are positive, then i would go ahead with ENS-Direct entry which doesn't have health waiver.

So is it a good idea?? so that i dont need to pay the agent fee and application fee and later getting rejected. Also, if at all i do medicals beforehand and if the medicals are negative, can i not simply not link the medicals with the visa application? will it have any effect later if i apply any other visa?

    Thanks for your inputs,

    Jen

    Hello Mr. Lombard,

    Greetings !!!

I am from India. We have applied for 189 AUS visa as Business ANalyst with 80 points.

Our process was going very smooth until we went for our medicals. We have twins 2 years old. One of my little one had a very compromised neonatal period.

She has motor developmental delay. Like she started independent sitting at the age of 15 months , standing at the age of 22 months. Otherwise she is very active child who responds to name, fair eye contact, follows all command, talk few words meaningful. She has some stiffness in her legs due to which she doesn't walk until now. As per doctors here the only treatment for her is physiotherapy. Her therapist is very happy the way she is catching on her milestones. The doctor at the clinic said that even mild stiffness in legs is called cerebral palsy but she is really not a bad case. The doctor put some comments on the  medical site and we were asked for developmental assessment. We went through the assessment and shared the report on emedical site and since then the  status is

Health assessed Wait for further advice from the department

Health examination results for this person have been assessed but further action may be required. The case officer will contact the person with further information.

Please suggest what are the chances of rejection or grant in this case.

    Many thanks in advance.

    Regards,

@Noop any update on your case? can you share your contact details? did u contact George?

    Hi All

I applied for PR under subclass 189 and got 70 point.

My son is 6 yrs old and has mild development issues, he still is unable to speak and is hyperactive. He has been diagnosed on spectrum.

He was analysed in Max by a psycholigist and she asked us a lot of question regarding his day to day activities, that we answered truthfully.

Now I recd a message from Immigration that says:

Invitation to comment on information for a Skilled - Independent (subclass 189) visa

    Adverse information received

The letter confirms that "my son has been has been evaluated by a Medical Officer of the Commonwealth (MOC) and has been assessed as not meeting the health requirement for the grant of Skilled Independent (Permanent) (class SI) Skilled - Independent (subclass 189) visa."

    The Medical Person Report says:

'The applicant has been assessed against Public Interest Criterion (PIC) 4005 [see attached extract] for the period of a permanent stay in Australia.

The applicant does not satisfy sub-subparagraph PIC 4005(1)©(ii)(A) in Schedule 4 to the Migration Regulations.

The applicant is a 6 year old person with:

    - Mild developmental delay.

..Form and Severity of the applicant's condition: The applicant is a child with mild developmental delay, from an unknown cause, and requires services to improve communication, cognition and social skills. Provision of services to a hypothetical person with the applicant's condition: A hypothetical person with this condition at the same severity as the applicant, would be likely to be to require community services, in the form of special education and disability support. This condition is likely to be Stable..

I consider that a hypothetical person with this disease or condition, at the same severity as the applicant, would be likely to require health care or community services during the period specified above.

These services would be likely to include:

    Special education services

    Commonwealth disability services

    State disability services

Provision of these health care and/or community services would be likely to result in a significant cost to the Australian community in the areas of health care and/or community services."

I am getting my son treated from an Institute in US and he is improving considerably, he has started to develop speech, behaves properly in social situations, is able to do most of hist daily chores himself. He understand english vocabulary and indicates to us through facilitated communication all his needs. He follows commands.

The doc who evaluated him has suggested that I should submit a reply to immigration official and attach a copy of the assessment report which has is given to us by the US institute and alongwith that attach a undertaking saying that I will be bearing all the medical expenses of my son.

    Now my question is:

    1. What are th chances that our PR will be processed?

    2. WIll my undertaking prove detrimental in future , if the PR is granted?

Sorry for a long post but I will be very thankful to all enlightened souls to guide me.

@itsme16may how did u go with your application? i am in same situation

Yes he has general answer and said if autism it will rejected ..but in my case it is learning disability in addition speech delay..he is grade 1 I do not know what will happen..we have to wait ..good luck

Hello @semsema how much did they charge? so if a child is autistic they are clear that it would be rejected and hence they straight forwardly that it would be rejected?
