Sad news this morning - my nomination was refused 😟

I'm awaiting a meeting with my MA to find out the reason why - once I know I will share it on here.

My application was more complicated than most and I sort of had this in the back of my mind this could happen but hey life goes on. I wasn't actually as upset as I thought I would have been.

Still currently on my 457 so no need to make any urgent decisions at the moment however at first thought - I don't think I will appeal. I see it can take another 12-18 months for your appeal to be heard and to be honest I don't think I can put our life on hold for that amount of time again. My wife wants to start a family and I don't feel comfortable doing that whilst sitting on a bridging visa awaiting the possible outcome - no matter how strong my case may be.

So it looks like my journey in Australia has come to an end - I have so many great memories here and I wouldn't change them for the world. I believe in life, things that are meant to be are meant to be and I guess its just our destiny to be back home. Although they wont say it, both my Wife and my parents will be over the moon I bet - they really struggled with the thought of us having a family out here alone.

Good luck to everyone on here - the forum has helped me through the process and its an awesome community that you all should be proud of.

I probably will take a step back from the forum now and I doubt I will post much more - just need to start planning the move back to the UK. My company has offices back home so I'm currently looking into an internal transfer.

    Farewell and God Bless 🍀

This is sad news - sorry to hear! Please keep us updated on the update from your MA.

Wish you all the best for the future

    Hi All,

I have been following this forum for awhile and would like to seek some advice from all fellow visa applicants here. I have applied for ENS 186 DE offshore and my nomination was approved in May 2018 and now pending confirmation on my visa approval. Once my visa approved, my nominated employer would need me to report in within 3 months. My question now is: -

    1. Once my visa/pr approved if i decided not to work with this employer, what will happen to my visa?

    2. Will it be automatically pull back or is there any rules stating that once visa approved i must start work with the nominated employer within a certain time frame?

    3. Or once pr approved, i must be in Aus within a time frame or it will be revoked? What if i delay my entry to Aus?

Thanks in advance and sincerely seek clarification and advice from all.

    Hi

    1. Well the whole point of this visa is that you work for at least 2 years with that employer or at least intend too.  It is worrying that you have reserves already of working with this employer after they have "invested" in the nomination application for you.  Your visa is granted on the basis that you intend to complete 2 years with that employer - If you applied for the 186 without a genuine intention to work for your employer for the full 2-year period, and it is determined that the application was made with fraudulent or misleading claims, then you are at risk and can lose your 186.

2/3. Unsure however usually offshore visa grants you have to enter by certain period (I think 3 months is correct)

I`m starting to think TRT is being approved quicker than DE. Please correct me if I`m wrong. The company has applied 1 year ago and just on the 4th of February the CO requested updated documents. Still showing as Further Assessment.

    Hi Eva.L

The visa processing times as per Home Affairs website would indicate that...

    DE:

    Processing Time
    • 75% of applications: 12 months
    • 90% of applications: 15 months

    TRT:

    Processing Time
    • 75% of applications: 12 months
    • 90% of applications: 13 months

However as we know in this forum really case by case - and above time frames are just indication and not always accurate.

Nothing ! been a year now ....I'm emailing my MA to see what's up

    Hi M.rvr

DE processing times at the moment as below, worth mentioning though that not all applications fall into the two categorys.  There are still applicants people still waiting from 2017.

    Processing Time
    • 75% of applications: 12 months
    • 90% of applications: 15 months

Hi, apologies if this is a stupid question but how do you know if the employer nomination has been approved or refused?  Does it show up on your immi account?  Or is it only shared with the employer?

Hi - it won't show up on your Immi account.  Will be shared with your employer/MA agent who ever lodged the nomination application

Slightly off-topic (for those that already have PR granted).

Once you have PR, does anyone know if, in regards to keeping immigration up to date on change of address etc.

    - Would updating this information in your VEVO account suffice / be required? Or would they specifically require you to update your "finalized" 186 application on the Immi site.
NOTE: Once you get PR, you get access to the complete VEVO system, showing / storing all your "resident" details.

I've heard conflicting stories and was wondering if anyone had experience in this?

There is definitely no need to update your 'finalized" 186 application on IMMI

The only thing you need to update them with is any changes in passport.

Address does not need to be updated after the Visa has been granted

Hello guys can I ask you one thing I have launched my visa on 2nd July and they guys open the august ,November files .is anything wrong my file or they pick the file randomly.I have uploaded all the documents when I launch my application. Thanks

The way the department work are random and clearly not processing the applications in order of submission.

Still people are waiting from 2017 and well before you.  You just got to be patient

    Hi Everyone,

very much confused with this 2/3 years:
Please find below screen shot and link (for TRT)

so you need to have total 3 years experience but 2 years on 457 (if VISA granted before april 2017).

    https://immi.homeaffairs.gov.au/visas/getting-a-visa/visa-listing/employer-nomination-scheme-186/temporary-residence-transition-stream

    image.thumb.png.af0cf70a4551afb01a4c782ee6704599.png

    for DE it is

    https://immi.homeaffairs.gov.au/visas/getting-a-visa/visa-listing/employer-nomination-scheme-186/direct-entry-stream#Eligibility

    image.png.d5233294e43145a7e63c01c6acfc088f.png

TRT - under the old 457 Grandfather arrangement to be eligible for 186 TRT you needed to hold your 457 for 2 years.  However after the changes must hold for 3 years.

Under DE you need min of 3 years work experience when applying

I can only tell you mine , my total relevant work experience as per ACS during my visa lodgement in august last year was about 10 months . I had the exact same concern about 3 years WE req for DE and the above response is what i got from my MA before lodgement. so 3 years hard bound rule is either for TRT or point tested visa as its not substantiated for DE yet.

For DE it is a requirement to have the 3 years experience.  Further back in this forum someones application was refused because they did not meet this criteria.

Tricky that nomination was approved。but the next co holds a different view.

Not tricky that nomination has been approved as separate from the application.  He can submit new application still under the approved nomination as must apply within 6 months of Nomination approval

    Hi All,

    Hope all well.

My low risk 186 TRT application was applied for on the 28th Feb 2018 using an immigration lawyer. I know the wait is long so I'm hanging in there. My agent requested more docs from my employer and payslips from myself, however I haven't heard anything since.

I checked my immi portal and didn't see any messages to my agent requesting these details.. should I see anything in the "messages" section? It's been over a month since I sent the docs. I've even requested more police checks due to the expiry, I've emailed my agent the last 3 days with no reply, I'm getting very annoyed with the lack of response. Has anyone experienced this before?

Am I entitled to request all comms between my agent and the immigration department?

    Many Thanks

    Hi

My MA did the same - just means they are on top of it as documents you would have supplied at time of applying would now be a year old.  So it is good that your Agent is keeping your application up to date.

Any requests from Case officer to MA you will see in the messages section of your IMMI account.

Thanks. Yes, true. But he got his skill assesment approved on the basis of previous experience, then why again he needs to prove previous experience?

And what would you say about "RELEVANT" experience. Exact cook or closely related positions ?

I would talk to MA to be sure.

However I found a statement from immigration stating:

"Relevant work experience will be considered in the context of the nominated occupation, and experience in related roles and flexible working arrangements may be recognised;"
