So i guess they lodged both at the same time. Had the nomination approved but visa didnt get assessed at the same time. Thanks.

I've noticed it's quite common recently that they are not assessing nomination and visa at the same time. I've got my nomination approved a week ago and no news/requested documents for a visa :).

    Hi Nat,

Are you able to apply on-shore for 189 (You as main applicant) while you are appealing 186 nomination ?

    Hi,

We decided not to appeal as it would have critical consequences and also the chances to win are minimal. I can't apply for 189 as a primary applicant, i'm way too young to have the experience, will be graduating this year and my occupation is not on the list (I work in IT but studying Marketing).

The action plan is to find the employer that is willing to sponsor us on 186 (we are on a good way) and in the meantime my partner will be taking IELTS (min. 7.0) to get more points for 190 visa and we will apply in September as we need more experience.

Fortunately, I don't need to take IELTS or PTE again as I was doing a Bachelor Degree on Macquarie Uni for the last 2 years.

@natmis I'm curious - if his employer is so keen to keep him. Could he not simply "sponsor" a DE visa, or even better a 189 (if you guys qualify for it).
    - When i say sponsor, I mean as in to pay for it.

If your 457 is running out, I've had a friend go from a 457 to the new equivalent (482) within about a month of application (they really quick).

He actually did pay for it, and he's keen to cover all costs.

We weren't on 457 visa, we came to Australia on 476 visa and then, after 1.5 year, applied for 186 DE.

    @natmis That's great news - i'm glad to hear it. The only question I have is;

How would the employer ensure to get any response from the department within 1 month?
Honestly - unless they have someone in the department to help, or an agent that "knows someone, that knows someone 🙂 ", I don't see it possible.
    - Also, if this was the case, surely they would have used this "connection" to speed your previous applications up. What's changed that they now have access to 1 month response?

Although it's great that the employer wants you guys, i'd be careful to not put your eggs in one basket and have a fall back strategy (which it sounds like you do), just in case.

Well, that's a good question. As far as I know, the start up is supported by the government as they are working on the common project so they know some people.

They can't ensure us that we will get a PR within a month so our priority now is to find another employer and that's what we're focusing on.

    Hi Natmis,

Why should you leave Australia and then apply for a new visa?

    Hi,

Sorry, I should probably quote my previous post. In short, employer's nomination has been refused and we wanted to withdraw the application.

They want to appeal but our migration agent says there is a vary small chance to win an appeal and tbh I don't have nerves to wait another god knows how many months.

We found out that if the appeal is being refused as well, you can't apply for any other visa being onshore -> you need to leave and apply offshore.

The question is - what are other consequences of appeal being rejected?

  6. Hey hey,

So I have a situation here...

Basically, my partner's employer doesn't want to let him go and he's ready to fight and appeal. Our migration agent says that it doesn't make sense because the chances are super low.

My partner said to the boss that if they want to keep him, they literally have one month to get him a PR as he already resigned. The boss says that they will make the application being fast-tracked (don't ask me why would we fit in in being fast-tracked as I can't find any reasonable explanation) and he will get support. They have a meeting today with another migration agent. Anyway, did anyone hear about the consequences and risks when the appeal is being rejected?

We know we would have to leave Australia to apply for another visa as you can't do it onshore, is there anything else?

    Thanks in advance!

@natmis Sorry to hear about the news - never good seeing these come through.

Could I ask, are you on a "higher than usual" salary, or is it more of the company can't afford a "affordable salary?

Also - applying for a student visa, although buying some time - might not help with employment, as you are only allowed to work a set amount of hours on that visa, which is not ideal for your situation (I assume).

Good luck and please keep us posted.

Just to clear some things out - I'm a secondary applicant, my partner is the one who got sponsored.

I would say that all experienced software engineers earn around $100k so that's not too high. I think that immigration don't take into the consideration money from investors. Simply, annual turnover needs to be in a good place.

I need to stay in Australia to graduate as I already have spent thousands of dollars on Uni fees 🙂 and I have just one semester left.

We'll see how it goes and if we won't find anyone to sponsor us, then we will go somewhere else:)

    Thanks!

    Hi Nat,

I got refused for the same reason in 2017 and still waiting for a response from the AAT.

You could try and lodge another nomination again providing more evidence to support the business situation and justify why the business is in debt at the moment by providing accountant letters, local business letter of support or similar things.

Many businesses are in debt but still manage to pay their employees wages is just the way it is in the world now.

If you research you can see that even the Department of Home Affairs is in debt, how do they pay their wages?

    Good luck

Hi, They are actually not even in debt.

They had a massive investment from the investors and they were able to pay the salaries from product sales. I don't want to appeal because it just takes too much time, having in mind the current processing times + they got refused twice, chances are extremely low.

If we won't find the employer that is willing to sponsor, I'll apply for student visa as I still have Uni till December 19.

  9. Hi Guys, sadly I want to share bad news with  you.

My nomination has been refused yesterday. The reason was exactly the same as the first time - the company is not able to pay the salary for the next 2 years.

I have to admit, I expected that but I had hope because financials looks waaaay better now than it was before.

Our decision is to withdraw and to find another employer asap.

    Cheers,

    Nat

    Hello There.

    Im new to this forum.

I have applied for ENS 186 visa as a Hardware technician in January 2019. Just want to know does anyone recently got approval as a Hardware Technician?

    Hi there,

Please check our spreadsheet, which is updated daily, where you can find who and when got the visa recently :).

Hay playitbyear it’s not hate I was just guessing because that’s the only profession which is moving very fast and always in demand 🤦🏽‍♂️

I wouldn't say so, there are still quite a few engineers that are still waiting.

Also, on this forum, we have seen a few cases where cooks were approved within the reasonable timeline so it's not a rule of thumb that no one cares about this occupation.

I suggest to sit tight, and as Hex always says: expect the worst, hope for the best. Especially that you only applied 6 months ago!  🙂

    Cheers.

    Hi all,

Just sharing a point of view, which it could be totally wrong, just based in some research and also the current approvals.

It seems to me that everyone who applied before March/2018 and haven't got the nomination approved will have to wait for the new financial year or perhaps for the new government....  the reason for that is because the majority that is waiting from before March/2018 doesn't have the profession included in the current list.

In the other hand they need to approve their "target" for this financial year, so they are approving everything that they can easily to reach that.

Does anyone have the same feeling? 😕

You might be right, who knows..

But recently I joined a few groups on Facebook where people are sharing their timelines and I saw a few posts with the grants from people who applied in 2017.

    Good Morning All,

anyone waiting from June 2018 and received famous email on 4th April, but nothing heard after that?

    Hi there

I am waiting from June, stream DE.

I think that there are more TRT applications processed now based on this forum's spreadsheet and Facebook groups🙂

Keep dying inside day by day. Only faith we have to keep. Frustrating with the immi processing. Some people waiting long and some just got within 2 month. Don't know exactly which month they are processing. Just pray to God everyone  will get it.

Based on our spreadsheet, which I try to keep updated, they are processing TRT May/June. For the applications lodged after 12/08, you're right, there is no visible pattern there. I heard the rumour recently that immigration outsources a company to process these but who knows if that's true 🙂

    Keep positive!:)
