  1. Dear Raul:

    I’m one of the regular visitor in this blog. Recently my 187 nomination refusal is under AAT. However, I already have positive skill assessment from vetassess as a Retail Manager. And I’m working in a newsagency in Alie Springs for 4 years (Retail Manager). My question is in future if my case is fail or business sold by the time, can I move to Tasmania and apply for 491 visa catagory 5 Small Business Owner? Do I have to be under Tasmania Skill Occupation list? As my occupation belong to Retail Manager.

    Please advice me with this two questions. It will be really helpful.

    hope this message finds you well, just need your opinion 187 visa lodged as Marketing specialist in June 2017 RCB and Nomination approved august 2017 but visa refused feb 2018 lack of experience did mistake from my side now AAT will be on august 2020 submitted all the docs which proves my experince what is you opinion about outcome.

      As the matter is complex I would need much more detail to be able to offer an opinion.

      If the application was refused based on not meeting the skill requirement of the Direct Entry pathway, you will face difficulty as this is a time of lodgement criteria.

      If you are being represented by an Agent, they should have already briefed you on the chane of sucsess.

  3. I have applied both nomination and 186 visa  for the job of General Accountant. The case officer has requested for license/registration for the job. I work under the license of my employer however I have tax agent registration license under my name. I have registered in CPA as ACPA. What license/registration do they need? I expect for your reply and recommendation. Thanks

  4. Hi

    I am currently on a 2 year 457 Restaurant Manager which expires on 6th July ,  I was planning on applying for a 186 (employer sponsored PR) with sufficient evidence, (registered relationship, live together etc) but our visa agent is saying that it isnt a good time to apply as the nomination may be rejected due to to coronavirus.

    My restaurant is still operating a takeaway service so i am still working 38 hours a week. But the visa agent says that since there are so many unemployed people around it might now not be seen as a genuine need for full time staff at the moment

    Our visa agent is suggesting waiting for a bit longer and then apply for the 186 once this situation has blown over? I personally feel what if after few months there will be more unemployed people if even restaurant takeaway closed down. 

    I'm just trying to find out what my options are should i just apply for the 186 now or wait a bit later? Any other options?

    Thankyou for listening me out. 
    i know we have many other things to worry about but i am getting restless about it.

  5. Hi Paul,

    I have an urgert situation need your help. 

    The immi called my boss 2 month ago, but my boss is not on office., so Hr manager answered the phone. I applied 187 DE on Jan 2018. 

    The new Hr doesn’t know my situation and answer the officer. 

    After company received email form Immi, my boss reply it and explain it. 

    The officer visit the office,and they still not believe the position is real. 

    Now they give 28days to explain the situation. My agent says I have to wait at most 3 month to know whether my nomin is approval or not.

    I Really need your advice. Thx in advance

  6. Hi Raul can you please tell me that if 457 visa  gets canceled due to not finding the another employer in time limit then 190 bridging Is also going to cancel?

    Could you help me understand this better, please?

    One of the changes to the points test in November 2019 will include:

    • 10 points for applicants with a skilled spouse or de facto partner (under 45 with Competent English, suitable skills assessment and with an occupation on the same skilled occupation list). Currently 5

    Does this mean the main applicant's spouse must also have both her education and work experience validated by the assessing authority (VETASSES)?

    Also, for a spouse is IELTS general accepted?

      Yes.

      Depends on the occupation and skills assessing Authority.

       

  8. I am interested in applying for a Visa 189. I am confident I can get around 80 points (test pass mark is 65) as I have relevant working experience, PhD, English certification, working experience in Australia under a visa 457, etc.

    I am a Chemist and I have been checking the Eligible Skilled Occupations for the Visa 189 and my profession is not included for this visa (https://www.homeaffairs.gov.au/trav/work/work/skills-assessment-and-assessing-authorities/skilled-occupations-lists/combined-stsol-mltssl).

    Am I eligible to apply for this visa anyway? Would it be rejected? I wonder if can apply under other related occupation such as Chemistry technician (which is available for 190).

    Can VETASSESS tell me what occupations can apply to based on my CV?

      Hi Borja,

      I am unable to give specific advice based on such minimal information, but consider the following general information:

      • The occupation of Chemist is not currently on the relevant list for 189 or 190 visas, so this is not an option;
         
      • The occupation of Chemistry Technician is on the short term list, which means a 190 may be possible, although it would require state sponsorship;
         
      • The two occupations are very different from a Visa point of view, so would not be considered related for points purposes;
         
      • Vetassess are an assessing authority and do not and can not give visa advice;
         
      • Depending on your specific situation, an employer sponsored visa may be more achievable.

  9. Hello, wondered if I could pick your brain on visa invites please.

    We have our EOI for 189 QLD on 70 points (3mth, no invite), we are considering a 190 NSW on 75 points as we'd prefer an invite by July, Hubby also turns 40 in Aug so points will go down!

    My question is : will 190 cancel our 189? If we get an invite on 190, will 189 still be active and possibly give us an invite?

    Ive also heard mixed reviews over 190 2yr stay. It holds no visa conditions ive been told....? We don't want to break the rules going so far from home to be made to leave, is that what could happen if we lived in another state?

      Hi Anna,

      It is difficult to comment based on so little information.

      Invites depend largely on occupation being nominated. Generally, it is harder to get an invite from NSW compared to QLD.

      Even for the 189, the occupation will determine the points required for an invite.

      190 has a two year undertaking wit the state, but no visa condition. I do not recommend breaking the 2 year undertaking as it may have future consequences, such as eligibility for Citizenship.

    Hope this message finds you well.

    I have applied for 186 visa under the TRTS on June 15th this year as Hotel and Motel Manager in Sydney. At the time, I was told processing times were from 6-8 months, now Immigration website says 8-10 months. 

    1- Do you think this waiting time is going to increase?

    I was hoping that the longest waiting period would be 8 months, that said, I would receive an outcome for my application before the new regulations comes 1st of March 2018.

    2- If it takes longer than the 8 months in my case and the result of my application is done after March 1st, am I going to be affected by it, or due to my application being lodged before that am I, let's say, safe?

    3 Are there more changes to be done to 186 under TRTS before March 1st?

      Processing time are very erratic at the moment and can exceed the Department's published processing  times, as these are just a guide.

      Further minor changes are being introduced in December.

      March changes are unlikely to affect current TRT applications.

  11. Hi Raul, my friend is on a 457 visa pork industry labour agreement and she is wondering if she has to wait 4 years to apply for PR or can she already apply before the 4 years.

      Hi Nicolo,

      It will depend on the terms of the Labour agreement.

      Each labour agreement is specific to the company, so it will depend on the terms of the Labour Agreement which has been negotiated, as to how long a 457 holder has to wait to apply for PR.
