186 visa timeline- dealing with a crazy boss whilst on a 457

Hi guys,

 

New to the forum and have read a few posts which is encouraging to see I'm not alone in the dilemmas of trying to achieve PR.

 

This has probably been discussed before but I am not

 

I am at the lowest point I have ever been in my life in OZ. Love the country, but my boss and job makes it a living hell. Bullied at work and working 12 hr days for peanuts. Being threatened the sack if u call in sick. Work 12 hour days and get only 20 mins lunch the whole day. Constantly being reminded that we could get sacked if u don't do what the 'main man' says.

My boss is a raging alcoholic with a drug problem.

 

I've only got till the 2nd of feb 2013 when all the paperwork for the nomination and visa application goes in together but there is no indication as to how long the visa takes to come as approved.

I don't even know if the company will last another year or so with the current financial blip.. And the alcoholic spending money on fast cars and buying houses which we as a small business cannot afford!!

 

Does anyone have any ideas or timelines for the 186?

Why don't you apply for PR independently? Leaving the moment a 186 is granted is not a great idea, if this person who is already bullying you decides to kick up a fuss it could call into your question your honesty in the application. So you are looking at processing time and then allowing a suitable amount of time to lapse first too. Skilled migrant visas are moving pretty quickly at the moment, it could be the way to go.

I think this is a really good point. I would say that the waiting times for independant and 186 are very comparable as you are an onshore application. Given the struggles you are having at work, and if you are eligable, independent seems the more sensible option. Cost wise they are roughly speaking about the same. I don't think that hanging on for the 186 will give you a visa any more quickly. So its worth looking to see if the other option is something you can do. This also means you could do it under the cover so to speak, without having to tell your employer.

 

The other thing, and don't hold me to this as I am not 100 % sure, but if you had an independent skilled visa application submitted into the system, and your current workplace folded, then I believe you may be put on a bridging visa with the same working rights as you currently have until a decision is made. With the 186, if the company folds, and your visa is yet to be granted, it would be refused on the basis of the workplace not being able to assure employment for a further two years - which is a condition of the 186.

Thank you for the info. You are right but my only issue is the experience I have in my field (sol list occupation) is only for 2 yrs. I have to have 3yrs or more so as to apply for the independent skilled..

 

I have racked my brains to see if I can do anything else ...

You dont need 3 years to apply for GSM? Or do you need the last year for points?

 

But you will need a positive skills assessment? Do you hold one?

Hi lebourvellec,

 

I need the 3 yrs for points.

 

I have not done a skills assessment + how do i go about it? How would this help? I have been working in the same role since aug 2010 whilst on a WHV for 6 months then got my 457 after that in feb2011..

 

Still brain racking but I dont even know if anyone has had their PR granted under the new 186 rules..
