Guest Gollywobbler Posted August 20, 2010 Share Posted August 20, 2010 Hi George This is excellent news. We have had somebody on Poms in Oz recently who wants to work for an employer in NSW. However the chap's daughter is not likely to pass PIC 4005 because she has learning difficulties, caused by something called a "crush injury" when a benign brain tumour was found and removed when she was only a baby. He was told by the AHC in London that if he agreed to a deal with the employer in NSW, it would be OK at the time of the 457 visa if the employer is willing to give an employer's undertaking under PIC 4006A but the subsequent application for a sc 856 visa would probably be held up because NSW had not signed up to the employer's health waiver. Apparently DIAC have been putting the sc 856 application into mothballs and just leaving it unresolved in this situation. The PiO member is very employable in Oz. He has been in touch with an RMA/barrister in QLD, who advised him to consider an employer in a different State. The guy is a structural engineer who knows about commercial ports and their construction/maintenance/what to do if a ship gets it wrong and rips out the mooring bollards plus half of the quayside whilst maneouvering alongside etc. I gather that the man is a Civil Engineer by background who specialises in this particular type of civil engineering. It sounds as if he can now resume his discussion with the employer in NSW, which would suit both him and his employer brilliantly. The important thing to remember is that "The State Government says NSW will assess each application for the waiver on a case-by-case, cost-versus-benefit basis.
