Help!!!!!!!!!!!!!!!!!

We posted a 134 visa on the 18th May(not heard anything yet) But in the mean time we've had a job offer,2-3 week ago not heard anything else about it till today when they email OH saying that this week they have lodged form 1196.I notice this is a sponsored temporary visa is this the new number for the 457 need advice HELP:err:

The 1196 is for the temporary 457 visa as you say and has no relationship to the 134 application. Employer needs to lodge ENS or RSMS sponsorship or convince the State body to approve an STNI Nomination for you.

WA have said they will sponsor us as soon as we send them a file number (of course thats when we receive it).

Think we're worrying as we'd told the employer we had sent the 134 of and the state would sponsor us ,but we can't understand why they have sent of this 1196 form.Is it something they just do?Or have they been not listening to us ?We don't want to loose the job or have a mess up with the visa.

maybe they have mis-understood. WA should be able to issue the STNI sponsorship approval to you before you get file number - you then apply for STNI visa or Skills matching - only difference is STNI requires 2 years experience in last 3 in Skilled occupation on SOL, Skills matching requires 12 months in last 18. Also, application fee for Skills matching is paid before visa issue, not on application and is AU$50 cheaper than the STNI fee that is payable on application for the visa.

 

Maybe company wants you out there on the 457 to start work sooner than you can if you wait for the permanent visa to be processed.

The work experience for a Skills Matching (subclass number 134) visa is 6 months in the last 12; for a Skilled - State Nominated Independent (137) visa it is 12 months in the last 18 ... the lower rwe requirement for the 134 visa is one reason why we tend to look at it over the 137 ...

Seems to me there may be a communcation issue here ... is the employer under the impression they need to seek approval to act as a business sponsor? Do they think they are sponsoring you for a long term temporary visa under, subclass number 457?

Yes, it is 6 months in last 12 regardless of whether the nominated occupation is 60 point or a 40/50 point occupation. With VETASSESS being the skills assessor, I have assumed it is a 40 or 50 point nominated occupation and thus the 137 will require 2 years in the last 3 recent work experience - So was pointing out the advantage of the lower recent work experience requirement for the skills matching visa but I did quote the wrong period - so thanks for clarifying that.

Have you any idea how long a 134 normally takes before you get the visa bearing in mind we have a job(up to yet to go to) and WA are waiting to sponsor us.We posted our applicaton on the 18th May

Assuming WA are nominating you for an STNI, it could easily take 6 to 9 months from when the STNI nomination is sent to Adelaide - you can speed up a bit by doing your health and character clearances a couple of months into the application - so the 457 may be a good stop-gap but you will have to leave Australia for a week to collect your permanent visa when it is ready.

Correct, if you need to go before permanent visa is granted.

 

Just keep Adelaide informed of your 457 situation and when you intend to enter Australia on the 457 visa.

if we continue to do both visas do we have to do medicals and police checks twice,or just the once (know this might sound stupid)

 

our employer has lodged this week form 1196 as we have said and given us their sponsorship number is this so we can continue with the application 457 visa or do we have to wait for more info as they haven't yet given us any formal offer or anything
