Hi Emmaroo we are going with Trueblue and at the moment they have been excellent Dealt will a lady called Joy firstly looked into seeing wether my Husband would be

eligible to apply for visa. Which he was then we have been pasted onto someone to deal with our case and have been great with responding straight away to any questions we have had. I would totally recommend them so far so go.

We took about a month looking into different agents and we liked the fact that if you don't get you visa you get your fee back which is reasuring. Hope you get on well DonnaX

Hi Emmaroo

Why are you not eligible for a temporary subclass 457 visa? Is it because you plan to move to Perth Metro but your occupation(s) is/are not on the SOL?

Depending on what you actually do, the Regional 457 visa followed by the RSMS visa later might be a possibility for you. If you are willing to consider living in Regional WA, that is.

What are your current occupations, please?

Best wishes

Gill

Hi Emma

What sort of Retailing? I know that food is not considered to be part of mainstream sales. Is Hubby genuinely a Sales & Marketing Manager who merely lacks a degree?

Sales and Marketing Manager 1231-11 - Australian Skills Recognition Information

The detailed description is here:

Market Research Manager

If he is the above except without a degree then provided he is comfortably under 45 there is no great reason why he should not be able to secure an employer-sponsored 457 visa in the middle of Perth Metro, it seems to me. That would be followed by an ENS visa for PR two years later.

What sort of Retail is he involved with?

If you are a Secretary/Personal Assistant then the chances of obtaining a visa via you would be slim, I suspect. If on the other hand you could properly be described as a Project or Program Administrator then this picture would alter as well:

This occupation would require an AQF Diploma. You might be able to do that via Recognition of Prior Learning:

Orion Training and Performance Management | Brisbane Training and Managment

The whole thing can be done via distance learning. I think the cost is around $1,500 AUD. If you get the qualification then you can get the skills assessment from Vetassess because all they do is to check the qualification and nothing else.

If you then get a job-offer (which again could be in downtown Perth) potentially you could by-pass the 457 visa because you would be in possession of a positive skills assessment. You could at the least bargain for the idea that the employer should sponsor you for an ENS visa sooner rather than later and certainly without waiting for two years:

Skilled Workers Permanent Visa Options- Employer Sponsored Workers - Workers - Visas & Immigration

Employer Sponsored Migration Booklet - Australian Immigration

As a Project or Program Administrator/Co-ordinator, independent migration would not be out of the question either as long as it is in Regional WA (which could include, say, Mandurah.) If you had a job offer from an employer in Mandurah or further afield from Perth Metro then it is not impossible that WA would consider sponsoring you for the provisional subclass 475 visa:

Skilled – Regional Sponsored (Provisional) visa (subclass 475)

Australian General Skilled Migration Booklet

WA will consider any occupation on the SOL, even if it is not specifically on their List for the subclass 475 Provisional visa:

State Migration Centre

State Migration Centre Skilled Regional Sponsored Visa

If you had a job offer from an employer in Mandurah then the Regional Development Commission for Peel might well be willing to support your application for State Sponsorship. However the Kimberley Region could back you instead and you can still move to Mandurah in that situation.

State Migration Centre Living in the Regions

Also, whereabouts do your rellies live? Are they in a Regional postcode?

Skilled – Regional Sponsored (Provisional) visa (subclass 475)

I certainly wouldn't be too ready to give in to the idea of a Student visa in your situation. The thing about Student Visas is that anybody who is solvent and has a pulse can be sure of getting one, ensuring that the Agent would never have to pay out on the "No Visa, No Fee" promise.

I would investigate the whole thing in more depth, hon, before you reach any conclusions. Also, I note that you are planning to go out to Oz on a tourist visa initially. That is fine but if you then decide to apply for a student visa, I am 90% sure you need to be outside Australia when you apply and outside Oz when it is granted:

Hi Emma

Are you both willing to revive OH's butchering skills as the basis for a visa application? I would definitely look into it in your shoes:

Butcher 4511-11 - Australian Skills Recognition Information

The occupation is on both the SOL and the ENSOL, plainly.

http://www.immi.gov.au/allforms/pdf/1121i.pdf

Do you know whether it is possible to obtain formal City & Guilds or NVQ qualifications in Butchery in the UK? I know that it is not possible for Locksmiths & Toolmakers but I've not seen the question crop up about Butchers before.

If it is possible to get formal qualifications in the UK then it may be possible to get them via a combination of Recognition of Prior Learning plus a workplace based assessment. Please see this article by Alan Collett of Go Matilda:

Go Matilda - Your Gateway to Australia - News

If the qualifications, apprenticeship etc can be sorted out then it might be possible for Hubby to migrate independently as a Butcher (provided he goes back to butchering for at least a year first.)

It would seem, though I am guessing, that if nothing can be done about obtaining trade qualifications in the UK, OH might be able to get the AQF III qualification instead, via a combination of ROSA and the Swan TAFE between them:

ROSA

Getting the AQF III qualification might be a better idea because as long as OH could then show 900 hours of work experience as well, he would be able to use TRA Pathway E in order to obtain a positive skills assessment:

http://www.workplace.gov.au/NR/rdonlyres/FA0FD1E1-8B74-4C11-AFBB-2C159890FF80/0/UniformAssessmentCriteriaSeptember2007.pdf

If you can sort this bit out and get a positive skills assessment for Hubby, either via AQF III or via whatever is available in the UK, then we move on to the possible visas:

First, the 175 – query, can he muster 120 points, given that Butcher is a 60 point occupation?

Skilled – Independent (Migrant) visa (subclass 175)

He would have to go back to butchering for not less than 12 months, though, in order to satisfy the requirement that he must have been employed in the nominated occupation for not less than 12 months in the 24 months immediately before the visa application can be submitted.

If Hubby is unable to muster 120 points (bearing in mind that the IELTS would potentially give him an extra 10 points, you are certain that you want to move to WA. Butcher is on the WA list for the skilled regional sponsored 475 provisional visa:

http://www.migration.wa.gov.au/media/documents/skills-in-demand-list.pdf

Butchers are needed in several Regions, it seems, including Peel.

State Migration Centre Living in the Regions

Alternatively family sponsorship might be possible instead:

Skilled – Regional Sponsored (Provisional) visa (subclass 475)

And if GSM is not possible, employer sponsorship is possible instead.

It is a bit fiddly with a 457 visa for Hubby, but perfectly do-able. As long as he is a Retail Butcher, he is eligible for an employer sponsored 457 visa and subsequently for an ENS or RSMS visa, but the emphasis is on Retail Butchering. Please see the end of Schedule A on Page 13 of the document below:

http://www.immi.gov.au/skilled/skilled-workers/sbs/occupations.pdf

The idea is to stop an abattoir hand or a wholesale butchering labourer of some sort from calling himself a “Butcher.”

So provided that Hubby is a Retail Butcher, I cannot understand why you were told that a 457 visa would not be possible when it clearly would be possible?

One of the episodes of the Wanted Down Under programme featured a Butcher who went to Perth. If you can get hold of it, it was the one with the Whelan family. They lined up 3 Butchers in the Perth area for Hubby to spend a day with, depending on which option he chose. As you know, the options are City, Country or Coast. They chose the City option. Hubby spent a day with a retail butcher in Clarkson, which I think is quite close to Perth CBD. The shop was extremely popular and busy. The Italian butcher who owned it had been in Perth for 50 years. He said he was desperate for a couple more skilled butchers to help him cope with demand.

He then had the family round to his house for Sunday lunch. Mamma mia! The Italian butcher had managed to get the very best fore rib of beef that I’ve ever seen. He cooked it outside on the patio in his pizza oven. It looked ruddy delicious, I can tell you!

I suspect that if OH maybe gets his hand back in for a few months (and possibly even if he doesn’t) followed by scouting round butchers in the Perth area, he might well get one or more offers of sponsorship plus a job.

Best wishes

Gill
