Partner visa - Baby Born overseas

Hello Dear All image.gif.9f24daec52d8802c24de2b959c4c9a43.gif,

I may have a tricky situation so kindly need some guidance, please! I am an Australian PR and have applied for onshore partner visa 820 for my wife. While she was pregnant she travelled overseas - India (with BVB) due to family concerns and delivered a baby overseas. So, I have added our child's details to my wife's existing partner visa application i.e. new-born's passport, birth certificate, 1436, 1022 forms, stat dec etc. as per Immi advice. This means my child is an additional applicant with my wife's partner visa application. Now, I wanted to have my wife and my child back to Australia ASAP. My wife won't have any issues as she has bridging visa to come back but how can my child come to Australia?

Applying for visitor visa for my child may not be ideal as it may get refused due to lack of 'genuine intention' (!)

When I called immigration, all they said is to wait. But the processing time for onshore partner visa is upto 2.5 years and now only 1 year has crossed. This means I can't join my child anytime sooner?? 😥

I would really appreciate your guidance/suggestions, please!🙌

Thanks
Sat

Nobody on immigration 'help' lines is qualified to give migration advice, as they frequently demonstrate.

The addition of your child to a subclass 820 was an invalid application, because applicants must be onshore to lodge a valid 820.

May I suggest that you consult one of the registered migration agents who posts on this forum for professional advice?

Hi wrussell,

Thank you for your prompt response. It makes sense to not add the child to an onshore visa application as the child was offshore at the time of application. I didn't pay the additional applicant fee anyway so this may not be a complete application.

What will be my option to bring my child to Australia? How can I approach any registered migration agents on this forum? Sorry I am very new to this things.

Thanks again!
